I am a US citizen. Married 4 yrs ago . Has a daughter and wife living outside united . Filed i130 for my wife and daughter . USCIS says the application is approved for both. My daughter is still minor. I am having another child in a month's time outside united states who's was not included in the already i130 that just got approved

Question 1. What next as the application has been approved? What do I have to do ?

Question 2. Is my unborn baby a US citizen or do I have to file another i130 for the baby?

3. How long before USCIS send an approved application to NVC in the designated country where the beneficiary resides?

Thanks for your help

When did you become a USC?

And when were your wife and daughter’s I-130’s approved?

I 130s do not take 4 years, I assume the new child will be a USC and hope you filed I 130s, one for your wife and the other for the child.

Creating a timeline on your profile would have helped VJ members to answer questions without asking here

Have u resided in the USA for last 5 years?

if so, u will file CBRA for the child to be a USC under your citizenship and provide baby with US passport

otherwise,  you need to file I 130 for the baby when born

I did not say it's taking 4 years. I have filed for i130 and the application for my wife and my child have been approved . I was asking what next since they have approved the i130 for both wife and child . And how long the process takes to get an interview at the country my wife resides

Please fill out your timeline: https://www.visajourney.com/timeline/profile.php?id=273349

Assuming your wife is completing consular processing, she will have to fill out her end of the paperwork (DS-260) for her and your child.  You will have to fill out the Affidavit of Support (I-864) for each of them.  There will be supplemental evidence required, including your last three years of US filed income tax.  Once those conditions are met and approved, an interview invite will be sent and an immigration medical will be required.

It’s all laid out step by step here - https://travel.state.gov/content/travel/en/us-visas/immigrate/the-immigrant-visa-process/step-1-submit-a-petition/step-2-begin-nvc-processing.html

Once you’ve been DQ’ed (hopefully only a month or so if you’re proactive), then interview wait time is here - https://travel.state.gov/content/travel/en/us-visas/visa-information-resources/iv-wait-times.html

Sounds like your youngest will be a USC, you can check it here. https://www.uscis.gov/policy-manual/volume-12-part-h-chapter-5

How old is the other child though? Just wondering if they’re a USC too?

She's 4. In my naturalization form I put her name as my daughter before I got citizenship. She was my lucky one as I got approved 4 months after she was born

Ah, ok. So yes, not a USC then and needs petitioning. Just to confirm you have two I-130’s, one for each of them? You can ask NVC to link the two cases so they’re interviewed together.
