Hi. So she has been self-employed for last two years and her AGI on tax returns exceeded 125% of the poverty guidelines. (Our household is 3 people, and she made around 36k and 38k). Here's the issues:

 

- She lost her job on Covid times 3 years ago and she didn't make a lot in 2022, only around 7k doing Uber Eats and Doordash.

 

-She is on a tax payment plan for the last two years of tax owed (around $5k)

 

We have been married for 2 years.

 

What are the chances that she'll get approved? Our families are not helpful and we pretty much don't have anyone else for us to sponsor me. If there's a high-chance of us needing a joint sponsor, is there any way to find a solution?

The usual issue with self employed is deductions, what do you mean by made?

That's what it's shown on the tax return. I don't think she used any business deduction other than her child and education credits.

 

Edit: We have a standard deduction of $27,700, we filed those taxes together.

Since she just meets the requirement, you may want to have a joint sponsor in mind.

AGI is not the relevant number, as she will have filed a 1040, not a 1040 EZ.  Her "current income" will be the amount shown as "Total Income".  Don't be surprised if that number is the same as the AGI, but "total income" is the correct number.  If she is not well over the required amount, you might want a joint sponsor.  On the other hand, if you are applying for EAD (work authorization) you may well be working by the time of the interview, and can bring a new affidavit showing both incomes.

Facts are cheap...knowing how to use them is precious...
