Hello there,

 

I was wondering how you and your lawyer see the current situation with traveling on a Greendcard and pending I-751 case. My lawyer said that "Each time you leave the country, you may not be let back in under the new rules." I do travel to Europe once or twice a year and try to stay there one or two months.

What new rules?  There are none.  How many Green Card holders have been refused entry? I know of none.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Maybe he's saying it because I submitted form I-751 one year ago and I'm still waiting.🤷🏼‍♀️

Your extension letter is valid for 48 months total.

My wife and I waited 44 months for our I-751 approval

@Verena Mona There are no new rules. However, green card holders or US citizens can be pulled over to secondary inspections at POE by the CBP. Given the current political climate, I've read more secondary inspections involve phone searches, in which if one does not cooperate, one can be detained for an inconvenient amount of time for further questioning or searches. In which case, you ask to speak to your lawyer. CBP can not deny entry to green card holders or US citizens, but they can deny visa entries.

Completely anecdotal.  I was on a recent work trip with 8 other collogues.  Some USCs, some LPRs, and one on an H1B, we all entered through Detroit Metro Airport, and none of us were sent to secondary.  Additionally, the non-citizen line was long, but was moving, and the USC/LPR line took only a few minutes to pass the immigration officer.  This was with three international flights arriving around the same time. 

 

A lot of fear mongering going on, and CBP may have stepped up vigilance of irregularities such as LPRs with long absences, or other things, such as questionable countries visited, etc., but if you are legal, expired CGC and extension letter is legal, you will be fine.

Thank you @Dashinka! I got back in mid February through ATL Int. Airport and everything was fine as well. Got through without 1 minute and no wait time.
