Confusion on dates of evidence

Hi just a quick question before filing! Is the dates of the evidence to be provided after the marriage occurred or after the green card was received? When we sent the green card application it had all the evidence up until application sent and during our interview we provided more evidence.

I-751 instructions ask for evidence from the start of marriage until date of filing.

 

I did that I got approved without RFE / interview. Some of the evidence was already provided during adjustment of status. I didn't mind sending it again, as it was roughly 10% of the packet. The 90% was new evidence from the time I got GC. I excluded evidence of relationship before marriage, which was sent during AOS as it was not relevant for I-751.

 

Many people submit evidence from the start of green card, and not from the start of marriage. It goes against the instructions but USCIS approves most of those cases just fine.

 

I'm also more conservative when it comes to interpreting I-751 instructions asking for "as many documents". E.g. I submitted all the pages of all bank and utility bill statements. Other people did quarterly statements and were approved.

 

It's your call.

Hmmm I have some from the start of the marriage, like bank statements, most of it is after green card including our church wedding which was right after the green card interview and we showed evidence of that too. I just know we showed a lot of evidence during the green card interview. Basically an entire folders worth.

Same was true for me during AOS. Remember, each stage - AOS, ROC, Naturalization - they're all linked but really independent petitions. You cannot assume because you got approval before you'll have easier time with new petition. The whole immigration system is designed to test you multiple times before giving a new immigration benefit.

 

As I said, I'm more conservative and give all the evidence as instructions tell to avoid any possibility of USCIS requesting more. The other school of thought is "they already have it, why do I need to give it again?"

 

You can choose whichever works for you the best.

I just realized I have the original document showing photos from when I first sent my green card application could I send that?

I-751 instructions specifically say from the start of your marriage so that's what we did. Definitely covers quite a bit of the evidence we've also sent in for the I-130/I-485, but I feel like you can't go wrong following direct instructions from USCIS to a T.

This is exactly what we did, and we also got approved without interview/RFEs.

Some of the evidence I repeated was the crucial one, for example joint leases from the time we got married, or joint bank statement or taxes. We didn't repeat pictures, but we did send in a few ones. 

My only interview was for my N400, and the officer said "you obviously knew how to put your package together"

October 17, 2019 AOS receipt date 

December 09, 2019: Biometric appointment

January 15, 2020 RFE received

January 30, 2020  RFE response sent

Feb 7: EAD approved and interview scheduled

March 18, 2020 Interview cancelled

April 14th 2020: RFE received

April 29, 2020 Approved without interview

May 1, 2020 Card in hand

 

REMOVAL OF CONDITIONS

February 1, 2022 package sent

March 28, 2022 Fingerprints reused

July 18, 2023 approval

July 20, 2023 Card in hand

 

N400 

January 30,2023: Online filing

February 4th, 2023: Biometric appointment

June 15th, 2023: Case actively being reviewed

July 11th, 2023: Interview scheduled.

August 30th, 2023: Interview!

August 31st, 2023: Oath ceremony scheduled.

Sept 19th, 2023: Officially a US citizen!
