221g IR1 visa -original marriage certificate Lagos Consulate (Merged)

Hello all,

 

My husband had his interview today and he was refused due to the marriage certificate not being compliant. The same marriage certificate we used during the I-130 was not compliant. They told us we would need to get a certificate from the registry. The issue is I am not in the country to sign off on it. Would it be acceptable for me to sign digitally as I cannot make it back to Nigeria in time. Has anyone been in a similar situation. This is an urgent situation your feedback is very helpful

Nigeria is known for fake documents. Make sure you get the right one, lest you get rejected again. 

 

No need to go back. Just get some credible attorney 

Immigration journey is not: fast, for the faint at heart, easy, cheap, for the impatient nor right away. If more than 50% of this applies to you, best get off the bus.

Hello all,

 

My husband completed his interview on April 4 in Lagos. The CO mentioned he would have given him an approval but he needed a marriage certificate from the court. What we submitted to the uscis was a marriage certificate from the church and that is what he brought into the interview. So after some back I decided to travel back the following week and go to the ministry of interior in Ikoyi. We received an affidavit stating we were already married 2 years ago and a marriage certificate from the federal ministry of interior. My husband submitted it all with pictures. My question now is how did the uscis miss this? Did We take the right step? Why has our case updated 4 times without any change for the status Is that weird? Has this happened to anyone

You must remember that the Consulate Officer is the sole approval authority for visas.  The Department of State has specific requirements for marriage certificate:

Nigeria (state.gov)

 

The path of least resistance is always to just give them what they want.  Updates mean nothing until the status states "issued".

August 7, 2022: Wife filed N-400 Online under 5 year rule.

November 10, 2022: Received "Interview is scheduled" letter.

December 12, 2022:  Received email from Dallas office informing me (spouse) to be there for combo interview.

December 14, 2022: Combo Interview for I-751 and N-400 Conducted.

January 26, 2023: Wife's Oath Ceremony completed at the Plano Event Center, Plano, Texas!!!😁

February 6, 2023: Wife's Passport Application submitted in Dallas, Texas.

March 21, 2023:   Wife's Passport Delivered!!!!

May 15, 2023 (about):  Naturalization Certificate returned from Passport agency!!

 

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Thank you for this I wish I knew earlier but we provided it all hope it will be enough
