Advice Needed: Sponsoring Brother Before He Turns 21 & Applying for Parents from Abroad

Hello everyone,

I recently became a U.S. citizen, and I'm now looking into the possibility of sponsoring my family to join me here. I have two separate, yet equally important concerns, and any guidance or shared experiences would be greatly appreciated.

 

  1. *Firstly*, I want to apply for green cards for my parents who are currently not in the USA. I understand that as immediate relatives of a U.S. citizen, the process might be more straightforward for them, but I'm curious about any challenges I might face, particularly with the current processing times and the best way to approach this.
  2. *Secondly*, and this is a bit more complex, my brother is turning 21 in 10 months. I've read about the Child Status Protection Act (CSPA) but am trying to understand if there's a way to ensure he can come here as well. Given the cap on visas for siblings, I'm worried about the potential waiting time and whether there's anything I can do to expedite the process.

 

I've also been considering whether there are any expedited processing options available for either case that might be applicable due to our family circumstances. Does anyone have experience with expediting family-based visa applications? What kind of evidence or reasoning did you provide, and how successful was it?

Any advice, links to resources, or personal stories about navigating the immigration process for parents and siblings would be incredibly helpful. I want to ensure I'm taking the best steps forward for my family.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

Timeline

Usually cases are fairly simple unless there are things like criminal history you have not shared with us.

 

Parents seem to be taking about 18 months currently.

 

Siblings a lot lot longer and they need to wait for the Priority Date to be current. However under or over 21 does not matter.

 

The fastest route for the Sibling is usually for the Parents to sponsor once they enter, F2b is faster than F4 but he can not marry before your Parents Naturalise, as there is no category for married children of Permanent Residents.

 

CSPA does not apply in this case.

The process is pretty straightforward for the parents as long as you meet the income requirements for sponsoring them. The more complicated issue is usually how to handle healthcare for elderly parents, especially if they are over 65 with no plans to work or if they have chronic health issues. There are plenty of useful threads on this topic if you search the forums here on VJ - there are significant differences between the states that affect the costs involved and support services available.

 

As the others have stated, it would likely take at least 20 years for you to sponsor your brother vs. 10+ years if your parents sponsor him once they are in the US. It is unlikely that you'd be able to expedite these timelines.
