Question about proof of US citizenship

Hi everyone,

 

I am a F1 visa holder in the US. My girlfriend is a US citizen. We plan to marry and apply for green card for me.

 

I know to one of the documents we need to submit to USCIS is her passport to prove she is US citizen. But her passport expired in Aug 2023. I am curious if it's okay to submit the expired passport. If it's not okay, we need to renew her passport immediately.

You can submit a certificate of naturalization. Otherwise renew the passport

Also are you in the US now? You would have to submit 485 as well but you can't adjust status if that was the intention all along

A birth certificate works, and it is not taking too long to get new passports anymore.

Yes I am in the US. That was not my intension all along. But I better apply 90 days after my last entry into the US to be safe right?

It's a myth about the waiting period. You can apply right away. When does your current status expire?

If born in the US, a copy of birth certificate is easier and less expensive to get.

If she needs to get a copy, Vitalchek works great.  I recently obtained my mother's BC using them.  I received it in about 3 days.

My visa expires in several months but my status won't expire as long as I haven't finished my degree.

Price of adjustment increases April 1.

A Birth Certificate for a U.S. born person is not always a proof of citizenship (even though it does in 99.9% of the cases)... A child born in the U.S. from foreign diplomat parents would typically not be a U.S. citizen.

 

The U.S. passport, even expired, is still proof of U.S. citizenship. Not sure why you would go through the trouble of getting a BC (unless your fiancée already has one at hand).
