Amman 221g administrative processing

Hello everyone,

 

I was wondering if anyone can give me some insight on my husband’s IR-1 case. On February 12th my husband had his visa interview in the Amman, Jordan consulate and he was only given 221g for missing documents. They wanted him to send more pictures of our relationship, upload our daughters birth certificate on the NVC website, and they wanted him to send his I-864 form (we had a I-864 ez form that we had all the qualifications in order to fill it out and it was approved by the NVC) even though he had it in his interview. So we resent the I-864 ez form again. On February 21st they emailed him to pick up something from Aramex. He was given again the 221g form to have me fill out I-864 and they also sent him the white paper to fill out the 10 questions for administrative processing 😞. We already sent the administrative processing form and I’m almost done filing out i864 form I’m just waiting on my 2023 tax transcripts as I just filed my recent tax year. I’m just wondering if anyone has went through this process?

when sending addtional documents for a 221 (or RFE)  u need to put the case #, both names and both DOB's on each paper 

CO's have a stack of work in inbox and to get your doucments to the right case #,   the CO will need the above info or all can be lost in a paper shuffle in someone's inbox

expect a long AP for the additional security checks    (CEAC site will say refused till the decision is made)

But I’m wondering why did they give him administrative processing when the first time they asked for additional evidence they didn’t want it? We have had a long visa journey until now and to be honest I’m very tired. I’m very close in filing a lawsuit against the us immigration system.

August 7, 2022: Wife filed N-400 Online under 5 year rule.

November 10, 2022: Received "Interview is scheduled" letter.

December 12, 2022:  Received email from Dallas office informing me (spouse) to be there for combo interview.

December 14, 2022: Combo Interview for I-751 and N-400 Conducted.

January 26, 2023: Wife's Oath Ceremony completed at the Plano Event Center, Plano, Texas!!!😁

February 6, 2023: Wife's Passport Application submitted in Dallas, Texas.

March 21, 2023:   Wife's Passport Delivered!!!!

May 15, 2023 (about):  Naturalization Certificate returned from Passport agency!!

 

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Lots of WoM discussions here, you may be too early to file, it is not a cheap option but may come to it.

This is something that has happened to a few people. 

They receive an RFE and then after the submit the first RFE they receive the second one.  They might not have known they needed to give the 10 questions until they received the additional evidence. 

You can file a law suit and I am aware you have been waiting for a long time but I suggest waiting at least 5 months after interview to file the lawsuit. 

I suggest this because AP is something they warn you about in Amman and you can read this on the website:

Most administrative processing is completed within five months of the visa interview. When administrative processing is required, the timing will vary based on individual circumstances of each case.  The administrative processing occurs in Washington, DC and can not be expedited or waived. Visa applicants are reminded not to make any non-refundable travel plans until they receive their visas.
