Hello,

I am filing out the i864, and I see that I need to report the 3 previous years of income. In year 2021 and 2020 i did not meet the income requirements

to sponsor my spouse, but in the year 2023 I did ($31,000) and my tax return will reflect that.  I can also provide 6 months of paystubs and a letter from my employer showing my annual income as $47,000. I do not have a joint sponsor; will I be denied? If I am denied will i have to redo the entire cr1 process, because I do not have a joint sponsor and her family member that lives in the US is unwilling to act as a joint sponsor also.

You should not have any problems with what you described, as long as she doesn't have several kids. They use your current income to qualify but include also your previous tax records as well.

Thank you, So it is fine if I only submit the current year tax return? (2023)

No, you really should include the last 3 years tax transcripts, or tax returns, with W-2's, etc. if possible. If you haven't filed this year yet, use last years if it's adequate income. I would definitely include an employer letter with current income with your case.

Information from three tax returns is entered.  Only the latest is required to be submitted.  Employer letter is OK, but include the latest pay stub too.  You'll most likely notice it shows year to date income.  No need for multiple pay stubs.
