How To File i-130 Expedite in My Situation

Hi all.

 

I've been living abroad with my wife. I have a severe potentially life threatening health condition and, quite frankly, the healthcare in this country is atrocious (I had a near miss recently). So I'm very concerned about my health while living here. However, my wife is my primary caretaker and I don't have anyone in the US. Of course, the healthcare is good in the US. So I'm in a bad situation either way and considering an expedite request.

 

I filed my wife's petition 6 months ago from her country and I'm booked to go home over the next few weeks. 

 

It seems like, if I stay here, I have to mail the expedite request somewhere (and, based on previous threads, it seems like no one will actually respond to it). Should I just mail it to our service center?

 

Or should I wait to get home, change my address, and then apply for it online? Is this option even possible?

August 7, 2022: Wife filed N-400 Online under 5 year rule.

November 10, 2022: Received "Interview is scheduled" letter.

December 12, 2022:  Received email from Dallas office informing me (spouse) to be there for combo interview.

December 14, 2022: Combo Interview for I-751 and N-400 Conducted.

January 26, 2023: Wife's Oath Ceremony completed at the Plano Event Center, Plano, Texas!!!😁

February 6, 2023: Wife's Passport Application submitted in Dallas, Texas.

March 21, 2023:   Wife's Passport Delivered!!!!

May 15, 2023 (about):  Naturalization Certificate returned from Passport agency!!

 

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

This was my experience filing an expedite request recently for a somewhat similar reason (medical diagnosis that requires hospital treatment and a tough recovery that would be much better suited in the US than my wife's home country). It did not require any mailing docs (yet), I submitted the request online via their live chat.

 

I have not yet heard back on the request decision, but here's what I have done so far:

- uploaded supporting docs and a cover letter for the explanation of expedite request to my uscis online portal

- Opened an Ask Emma chatbot and used Live Chat option to connect with a real agent 

- Asked them to submit an expedite request for me

 

They gave me a reference number and some instructions on what's next (response usually 7 days, but can be longer) and that's where I'm at. Hope this helps

If it's really serious, you can get a politician involved. I recommend the Senior US Senator from your home State.  They may not help expedite your case, but they can help arrange a non-immigrant visa so your spouse can accompany or follow you to be your caregiver temporarily.

Facts are cheap...knowing how to use them is precious...

You do NOT have "assurance" of anything.  You have some actions to take, that have no guarantee you'll get the result you seek.

I meant that I have some degree of reassurance that I could at least apply for it online (obviously, I have no assurance of a particular result).

 

The only other thread I found on this topic was from 2 years ago. The USCIS online representative told the person that they had to send a snail mail letter to their service center just to inquire as to how to start the process. That situation would be much worse.

That sucks. I'm also a 100% disabled vet. The condition is what I'm rated highly for.

 

What kind of evidence did you submit that resulted in a rejection? It seems like these kinds of cases were being approved for expedites in 2023.

 

It's just awful how the US treats its veterans.

They responded on the 7th business day and the expedite request was rejected, unfortunately. I may reach out to Ask Emma to see how to strengthen the request, as the rejection email was fairly vague

That is not how it works.

 

If she needs to visit the US for urgent medical treatment that look a the B2 Medical Visa.
