how to handle RFE

hello..

i require some assistance regarding the RFE. recently we received the dreaded REQUEST FOR EVIDENCE (RFE) . despite attaching the marriage certificates (NIKAHNAMA muslim marraige certificate) and all the supporting evidences, uscis has still requested more to establish a bonafide marriage. the letter clearly states INTENT TO MARRY WAS BONAFIDE as an objection and further mentions all the possible evidences that one can submit to corroborate the claim of a bonafide marriage. i must mention here that we did not send pictures of our marraige with the original i-130 as we were given to believe such documents are required at the interview and not along with the initial i-130 packages. 

 

in light of the above information what should be the right course of action and how should we proceed with addressing their objections. further i wish to know how would this letter effect my chances of sucessfully completing the procedure.?? is RFE really a bad omen for the entire green card application. is the application doomed forever or is it fixable ??

Timeline

It is unclear what process you are in.  Is this RFE from the consulate interview, or are you at the NVC stage, or doing AOS?  Maybe provide a picture of the RFE with personal information redacted.  In the end, it seems someone is looking for more evidence of a bonafide marriage, so your only option is to provide any additional information you have showing a commingling of the marriage (things like leases, joint bank accounts, etc.), maybe photos or even affidavits.

we are still at the NVC stage.. we were waiting for the final approval but instead received the RFE.. is it normal for USCIS to ask for more evidences at such initial stages. i mean we did attach everything that could corroborate a bonafide marraige.. my wife in usa and i am still oversees so things like joint bank accounts and leases are still out of question.

Ok, so NVC is not DQ’ing the case without additional information.  Your USC spouse may be able to add you to things like utility bills, set up a joint bank account (not all banks require a SSN to be put on an account), add you to a lease, etc.  NVC is a different federal agency, part of the Department of State whereas USCIS is part of the Department of Homeland Security, so yes, NVC can request more information even though USCIS already approved the I130.

If USCIS sent an RFE, you are not at the NVC stage.  Please remove any personal information and post the exact wording of the RFE.  Also share the country.

August 7, 2022: Wife filed N-400 Online under 5 year rule.

November 10, 2022: Received "Interview is scheduled" letter.

December 12, 2022:  Received email from Dallas office informing me (spouse) to be there for combo interview.

December 14, 2022: Combo Interview for I-751 and N-400 Conducted.

January 26, 2023: Wife's Oath Ceremony completed at the Plano Event Center, Plano, Texas!!!😁

February 6, 2023: Wife's Passport Application submitted in Dallas, Texas.

March 21, 2023:   Wife's Passport Delivered!!!!

May 15, 2023 (about):  Naturalization Certificate returned from Passport agency!!

 

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

And no, an RFE is not a "doomed" indication.  It means exactly what it says.  They want to see more information of a bona-fide marriage.

 

Be aware that you won't get a second RFE.  If you do not satisfy the requirement of the RFE, they may reject your application and you have to start over again.

 

Review the list of possible evidence.  Submit as much of it as you can.  Pay attention to the deadline.

 

(I've gotten at least two RFEs since I've been dealing with USCIS.  All have been resolved and the beneficiaries received their green cards.)

So, you did not bother to follow the instructions and send any evidence of bona fide relationship, OR the passport photos of the petitioner.  Since the beneficiary is outside the USA, the are not required for them, but you can send anyway.

 

Most important is evidence of time spent together in person.  Primary evidence of visits in the entry and exit stamps in the traveler's passport. Secondary evidence is photos together, and examples of how and how frequently you communicate.  Don't send any "affidavits".

 

WHICH COUNTRY?  It matters.

sorry for the delay..got occupied elsewhere.. it was my understanding that pictures and other supporting docs are required at the interview stage therefore i didnot send any.. seems like i made a blunder.. regarding your question about country of residence,i live in pakistan... what should be the best course of action here...

The course of action is to respond to the RFE with as plenty of relevant relationship evidence, and as you go forward, stop "being given to believe".  Instead, believe and follow the actual instructions.  Each form has them.  Become an A-Student of both the forms AND their instructions before proceeding.

 

Are  you the petitioner or the foreign spouse?  The RFE would have been sent to the petitioner and it is THEIR responsibility to respond.

no..i am the foreign spouse and my wife is the petitioner off course . she will respond obviously but i am also collecting as much information as i possibly can so that we dont make anymore mistakes.
