Hello everyone,

 

Please I am trying to find out about filing for a sibling already present in the US. i-94 expired over 6 months ago. I can file a petition according to USCIS website....forms I-130 along with I-485, but am not sure what waiver to fill out.

Also can they get a work permit while the process is going on? Any answer will be appreciated on directions to follow

You can file an I-130, but your sibling cannot file an I-485 since their priority date will not be current for 20 years or more  A sibling is not an immediate relative.  No, they cannot legally work or legally stay inside the US during the process of a sibling petition.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

There is no waiver or way to expedite visa number availability.

I assume they have a 3 year ban, being out of status for a year will up that to 10 years so they need to leave asap
