i am self employed working as a graphic designer and filed my taxes 2022. Regarding poverty guidelines what income do they look at for self employed is it GROSS income or net income? total income? also would be very helpful if you can tell me if you know ofcourse which line of 1040 I can look for my income.

 

I am also divorced with one child but my ex wife claims him every year as a dependent so my family size will be myself and my spouse which will be 2? not including my son because I dont claim him on my taxes.

 

My gross income 2022 was 40k

my total income 25500

my adjusted gross income 23500

 

I am very worried if I will meet the 125% poverty guidelines..

They look at AGI. I believe line 22 on your 1040.

It's the number on the line named "total income".

 

It is not your gross revenue. In this context, income is revenue minus business expenses.  Again, you find the number labeled "total income".  That is not only the number for the tax section for 2022, but also your qualifying "current income" if self employed.

Facts are cheap...knowing how to use them is precious...

Yes, you do need to count your son, so you have a household of 3.

The I-864 instructions state:

Your household size includes yourself and the following individuals, no matter where they live: any spouse, any dependent children under 21 years of age, any other dependents listed on your most recent Federal income tax return, all persons being sponsored in this affidavit of support...etc.

 

Your son is still a dependent regardless of how taxes are done and where your son lives. 

 

Unfortunately, your income will not qualify with a household size of 3. See below: 

2   $24,650
3   $31,075

Even with a household of 2, it's cutting it too close. You'll need a joint sponsor, unless you can get a W-2 job that has qualifying income.

Yes, you must count your minor children no matter where they live.
