Interview Expedite Request

Hi, everyone. My wife is a U.S. citizen and filed Form I-130 for me. Thankfully, my case was approved and is documentarily qualified. I’m waiting for the interview appointment at the moment.

 

The thing is, she’s pregnant and will give birth in a couple of months. She needs me for both medical reasons and psychological support.
 

She intends to submit an expedited request so I can make it to the birth of our first child. 
 

Will those circumstances make the NVC grant our request? If yes, how soon can I get my visa?

Pregnancy is not a valid reason for an expedite.  See the thread below.  Even an expedite will, likely, take weeks or months.

pregnancy is not considered a life and death situation

 

Immigration is getting so  many requests  for expedite that Hacking Law has statements and a video on the subject

Can I expedite my case at the National Visa Center? Hi, I'm Jim Hacking, immigration lawyer practicing law throughout the United States out of our office here in St. Louis, Missouri. A lot of people are seeing a lot of delays of their immigration cases, and they believe that if they send in an expedite request, that is to try to get their case moving along faster that the National Visa Center, or even USCIS or the embassy will make their case go faster.

In my experience, requests to expedite unless they are the most dire of circumstances, somebody is literally dying, request for expediting are almost always denied. Or in other words, they just go off into the ether and no one ever rules on it, nothing ever happens on the case. So filing a motion to expedite is something that you can do. You can request that the embassy move faster, or the National Visa Center move faster or USCIS move faster.

And in the vast majority of cases, this doesn't work. Now, I'm sure there'll be people who will comment down below that say that that does work. And I'm not saying don't do it. I'm just saying, don't get your hopes up. Really, the only thing that works is suing them. And threatening to sue them, that doesn't work, having a Senator or a Congress woman email them or contact them that doesn't work, getting the ombudsman involved or emailing them every day. None of those things work.

Forgot to add Expedite requests can take a couple of months to be reviewed, timelines seem to be all over the palce.

 

Realistically much better just visiting.

Which country will you interview in? 

When were you DQ'ed?

And what is "a couple of months"?

Egypt.

My case was documentarily qualified on April 6th, 2023.

In 3-4 months.

Oh… I was hoping you were at an embassy with a quicker turn around… 

This poster was DQ’ed in May 2022 and interview in December… following the same timeline if Egypt hasn’t sped up you should interview in October or November 2023.

Applying for expedite might work. But if you sent in a submission now you might end up having to schedule your own appointment which could mean an interview in October/November anyway… 

but it doesn’t hurt to try…
