I-751 Filled June 2021 Ext Set to Lapse March 2023

Hello, 

 

I'm wondering what next steps I should be taking as when I filled my I-751 in June of 2021 I received a 24 month extension to my I-551. Based on the extension given it will lapse as of March 7, 2023. I have started filling out my I-400. I tried requesting a status update online but since we are still just within the 24 months it wouldn't send one through. Should I send additional information and pictures showing that yes my husband are in fact still married hoping to to maybe say hey don't forget about me and approve this?

 

Looking for any and all suggestion.

1. Call USCIS and request 48 month extension letter. If not, at least get Infopass appointment at your local field office to receive I-551 (ADIT) stamp

2. When filing N-400, include copy of I-751 receipt and in cover letter explain you still have ROC pending, asking for combo interview. 

Of course, include all the bonafide marriage evidence in N-400.

I'm sure this is a dumb question but does the I-539 application to extend/ change status apply here or is that for different cases? When I tried calling USCIS to request the 48 month extension letter I couldn't ever get through to anyone and they just sent me the link for this form.

No, I-539 is not applicable. It's for extending a non-immigrant status. Totally irrelevant to you because you're LPR.

 

Ask for InfoPass when you call the USCIS number.

I am in the same boat.  My 18 month extension expires March 18.  I called and asked for infopass and spoke to someone that said they sent me an extension in November.  While if so it never arrived?  She said she would ask for it to be resent but it could take a month??? Carrier pigeon i guess? Anyways I have my n400 interview March 29 so I guess I will have to Uber there but while I am there something will hopefully get figured out.

Your status remains the same after your extension letter expires.  Good luck on you citizenship interview.

You can call them to ask for an Infopass appointment to get the i551 stamp that is available for one year. You can use that stamp in lieu of the green card. 

In my experience, they called me back after 2 days I made the request for a callback.

Some people think they must have an ADIT stamp to maintain status.  That isn't the case.
