Good day VisaJourney friends and Happy New Year! Am hoping I can pick some of your most-knowledgable brains.

 

My parents are filling out the I-134a for a family of 4 that we have known for many years who are going to be registering for this new program that launched on Jan 6 of this year to come to the states due to the economic and political disaster that is Nicaragua right now. My folks have been coming to me for a few questions they have as they understand MOST of what they need to do except this part...to which I respond "I have no clue". 

 

Background: They are farmers (self-employed) and their personal taxes show little to no income because they run everything through their LLCs. They have a ton of land that they are hoping to show that they have more than enough assets to qualify. On paper with the IRS they don't seem to have much income but this is far from the truth it's just under their farm business entities and not their personal names if that makes sense.

 

Question: What sort of supporting documentation can they submit to show this? Asset balance sheet? 

They have a statement from their local banker with the beginning and ending balances of their personal accounts and total of all deposits for 2022 per the instructions. 

They have a statement listing all land owned plus the value of that land that has been verified or signed by their local Farm credit service representative.

What else?

Supporters must file a separate Form I-134A for each beneficiary, even minor children. Multiple supporters may join together to support a beneficiary. Individual supporters filing with or on behalf of an organization, business, or other entity should submit evidence of the entity’s commitment to support the beneficiary when they file the Form I-134A. This can be demonstrated through a letter of commitment or other documentation from an officer or other credible representative of the organization, business, or other entity describing the monetary or other types of support (such as housing, basic necessities, transportation, etc.) the entity will be providing to the specific beneficiary. Individuals who are filing in association with an organization, business, or other entity do not need to submit their personal financial information, if the level of support demonstrated by the entity is sufficient to support the beneficiary.

I tend to prefer the KISS approach, the requirements are minimal and not legally enforceable so if someone with a simple income can step in that would in my mind be easier.

I'm blind as a bat! Thank you for pointing out this little blip as I totally missed that trying to help point my folks in the right direction. I agree that a simpler income would be easier for sure! The worst that can happen is they apply then are either asked for additional supporting documentation or simply are denied, in which both my folks and our family-friends are willing to accept. 

A letter of commitment seems way too simple. We will see!

I'm guessing this response is coming way to late, but just in case it might be helpful to someone else who sees this thread, I'd submit the tax paid under their LLC. In the first or second page when it asks for the sponsors name, it also asks for the business or organization that will contribute to sponsoring the beneficiary. If they are using the income from their LLC for the sponsorship, I'd include that there. 

 

However, I also agree with the person above, so hopefully ya'll already heard back and it was positive! Best of luck!

Always good to see a fellow member representing Nicaragua! So My folks ended up submitting their personal tax transcript, bank statement, and 401k quarterly statement and left the LLC's alone/didn't include and were approved. 

We are just dealing with another small mess of one of the beneficiaries' DOB off by 1 digit (birth month is 11 instead of 10). Learned after a month of waiting for a response in the secure inbox on their USCIS my account that they have to upload a signed letter. Unbelievable it took them a month to click in. We are really hoping it doesn't take an additional month for someone to go in there and make the change as the travel authorizations are only good for 90 days. 30 of those days are gone just because it's taking so long for any kind of online response

That's horrible! In a perfect world we'd actually be able to call a helpline and be transferred to an actual agent who could quickly resolve this issue. Unfortunately, as i'm sure you know all too well, people are really on their own with anything and everything to do with immigration.
