K1 I-129F - Reapply

Hi Everyone,

 

Long story short,  me and gf is reapplying again for I-129f, she was approved and we did cancelled her visa due to personal reason.

 

my question is regarding Question 43 in 129F.

 

43. Have you ever filed Form I-129F for any other beneficiary?   - should i answer NO? since i am reapplying for same beneficiary.

Its a little ambiguous i agree .. but I would answer yes .you have .USCIS will see your previous application   These forms are not great dealing with uncommon situations.  If the question was just ” have you filed any other /previous I 129f” you would easily answer “yes”   I wouldn't answer “no” on a technicality or wording

At this point, I would also be considering getting married and following the spousal visa path.

 

Beyond that, if you are set for another K1/I129F submission, I agree with @Lil bear, I would check "Yes" for that question.

I agree with previous speakers that answering yes is "safer", however:

 

Do try to avoid the RFE. Explain the beejesus of the situation using additional pages, if necessary, even include the original I-129F if you can find it, stapling it to the back of the "additional information" section.
