Hi, I'm American and my fiancé is Brazilian. We're just now beginning the K1 visa process. I've talked to a couple people. Some people have told me that it is ALMOST IMPOSSIBLE to get a K1 visa for him to come join me here. A Brazilian married to an American told me it's better to marry in Brazil and get a spouse visa. Unfortunately, that seems a little financially prohibitive at this point (plane tickets for BOTH of us, maintaining rent here, not working while I was there, etc.) whereas if he were to come here that would be manageable. I'm afraid to go through this process and then have our request denied (after having wasted so much time and $ and hope). We're willing to do whatever it takes, but can somebody tell me what the CHANCES are of having our request denied, and what we can do to make sure it comes through? I'm worried! I just want to be with my love as soon as possible (and we realize it will probably be a year or so.) Any input would be extremely appreciated, especially from US-Brazil couples who have both succeeded and failed at their requests.

PLENTY of US/Brazilian couples on here have got K-1 visas. Lots of them. :)

2005 - We met

2006 - Filed I-129F

2007 - K-1 issued, moved to US, completed AOS (a busy year, immigration-wise)

2009 - Conditions lifted

2010 - Will be naturalising. Buh-bye, USCIS! smile.png

Yes, plenty of people here with K1 visas coming from Brazil. Start by reading the guides and getting prepared. Become educated about the process and follow what you learn and you will reap the reward eventually.

Please read the guides, there are plenty of us brazilians that went through a K1, succesfully.

I can only see reason to worry (and then it's a certain denial) if you two haven't met in person prior to sending the application. If that's your case, you'll have to meet in person before going down this route 'cus one of the requisites to file for a K1 is having met in person in the past 2 years.

Ditto! My husband was told my several of his friends that we just had to get married in his country before he could come here and there was no way around it. Obviously, they were wrong. It actually would have been harder for us to file the K-3. And if you dont believe the K-1 cant be done, look at how Luis and Laura ripped through theirs, that ought to be proof enough for anyone :)

The K-1 visa process is still the quickest method. I haven't heard anyone on VJ that was involved in Brazil complain about longer delays that the average person. Review the guides for K-1 and if you fit all the criteria, then go for it.

Thanks for the input, everyone!

A couple other queries: I've been thinking about paying the $1000 bux or so to an attorney to help, since they claim to have 100% success in obtaining the visas. Does anyone have experience with these companies, or think that it's unnecessary?

The only problem I can think of with our criteria is that, well, we just met in February, and although it hasn't been that long, we are completely sure we want to spend our lives together, and especially since it's going to take a LONG TIME to process these documents, we don't want to waste any time "dating" from overseas...Would they deny us on the basis that we didn't date for very long?

Also, while I was in Brazil, through some dumb fluke I only got a 30 day tourist visa, which I overstayed for about 2 months.

And, we only have but ONE photo of us together (since my camera was stolen 2 days after we met :( and he didn't have one at the time.)

Are these issues a big deal, do you think?

It doesn't matter whether you met in February or not. As long as you've met within the last 2 years of filing for a K1. As far as your proof, photos are secondary evidence. You have your passport with the dated stamps showing you were in that country at the time of meeting? You have your flight itinerary? Boarding passes? Receipts, etc.?

About the attorney, that's up to you if you wish to hire one. Most of us here at VJ, were able to do the work ourselves. We were the only ones who could guarantee OUR 100% success rate. As long as you don't think there are difficulties in your case, you may not need one. But, as I have said, that decision is up to you. Best of luck!

The amount of time you've been together doesn't reflect upon your petition as long as you can provide evidence that you have a genuine relationship. They won't deny you simply because you've been dating for a short time.

USCIS will want more concrete evidence, such as boarding passes/itineraries and passport stamps. Photos will help to build the evidence, but that alone won't be enough to pove.

A lawyer may be good if there are concerns with you overstaying your visa, but if it's a very simple case, then it probably won't be necessary to hire a lawyer. They can't expedite or make your case faster - and sometimes it can take longer, since they may be handling many cases and won't send out things on the day that they get them.
