In immigration terms, is it though? Isn’t there a waiver available? (Though I guess the attorney would have mentioned it. Maybe.)

(vs there being no waiver for claiming ti be a citizen, for example)

From an Immigration perspective I think of it as one down from False claim to USC, but I think that is theoretical

The only marriage fraud /sham marriage waiver available is while in removal proceedings…but once that battle is lost, there are no waivers …it’s a Forever Bar. Note VAWA is also not exempt…

Can I Get a Waiver for Marriage Fraud?

You can apply for a section 237(a) (1) (H) waiver if found guilty of marriage fraud and deemed inadmissible. However, this provision doesn’t cover a new immigrant visa petition or any subsequent petition, but a chance to waive and avoid removal proceedings.

Why would a U.S. citizen need or be eligible for a visa to the US?   Do you know what the purpose of a visa is?
