Hello, My fiancée is a U.S. Citizen, we are planning to get married in the U.S on Sept 23rd , I will fly there on my B1/B2 tourist visa and I will return to my home country after the ceremony and my fiancee will start to process the I-130 after my return home.

I'm confused about the 30/60 days rules from entering the US  (in my case- getting married)  and I'm trying to get clear explanations from few lists below: 

 

1. Would our situation still be considered fraudulent even I was not try to attempt to stay in the US after we get married ? 

2. So in order to fulfill the 30/60 days rules , should we filled the I-130 after 60 days from the date of the marriage? can it be filled sooner? 

 

As I will be waiting in my home country while the I-130 on progress and wait until the interview's date from the US Embassy is produced 

Anyone here had the same experience? Thank you all in advance ..

1.  No.  Many people marry in the US, then return to home country.  Nothing wrong in doing so.

2.  No.  There is no rule for filing the I-130.  It can be done any time after marriage.

August 7, 2022: Wife filed N-400 Online under 5 year rule.

November 10, 2022: Received "Interview is scheduled" letter.

December 12, 2022:  Received email from Dallas office informing me (spouse) to be there for combo interview.

December 14, 2022: Combo Interview for I-751 and N-400 Conducted.

January 26, 2023: Wife's Oath Ceremony completed at the Plano Event Center, Plano, Texas!!!😁

February 6, 2023: Wife's Passport Application submitted in Dallas, Texas.

March 21, 2023:   Wife's Passport Delivered!!!!

May 15, 2023 (about):  Naturalization Certificate returned from Passport agency!!

 

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Nothing fraudulent about marrying in the US while on B1/B2 visa, then leaving on time.  The challenge is convincing the CBP officer on POE that you intend to leave on time.

 

I married in the US while on B1/B2 visa, then left on time.  I had a bit of hassle with CBP at my POE, but I was eventually let in.  My wedding was less than 30 days after my US entry.  Now I'm an LPR after returning to the US with a spouse visa.  At no point during my visa process was I ever questioned about the timing of my wedding in relation to my US arrival.

You  have answers to 1 and 2.  Many have done the same.  It is also possible for you to visit during the process.  See the pinned thread on the subject.

Thank you for all the responses, I'm married now, so we are on process of submitting the I-130 now, and yea.. there are some confusion on few of the parts on the online I-130 form 

so , I will open a new thread and hoping that members VJ can help me sort it out..
