My beneficiary is still waiting for vaccine and passport. I encouraged her to get written permission for my godson to travel. The father declined. 

I know it is an attestation at the application stage. Is it required to get on the plane?

Father declined to allow his son to travel but you don't want to respect that? Is that my understanding? If father has declined then the son shouldn't travel. Unless, I'm missing part of the story.

You are starting to get into International law violation territory here. Beyond that CBP will not allow the child to travel without proof of guardianship.

I (or she) misspoke. She declined to ask. Children have been crossing international borders without documentation, including the USA, with no documentation since the war started.

Her question is will this be a problem?

Does the child have an immigrant visa also ?

No. He is on his mom's passport.

She is applying for a separate passport but asks if it is necessary. I told her no based on this from CBP.

 

You may encounter minor citizens of Ukraine with approved U4U travel authorization listed as a dependent in their parent’s valid Ukraine passport. Ukrainian minor dependent children listed in their parent’s valid, unexpired, Ukrainian passports meet the passport requirement for dependent children accompanying the adult holder of the valid passport

It is Ok that the child is on the Mom's passport. But you will need to file a seperate I-134 for the child referencing Mom's passport.

I forgot to add, though it might be obvious, the Mom and child must travel together.
