Tourist Visa instead of Spousal Immigrant Visa Dominican Republic

We would like to apply for a tourist visa for my husband as opposed to an immigrant visa. We actually live in the country and just want to go visit family. We’ve been married for over 2 years and live in a house that we own. An immigrant visa would require us to live there and disrupt our life here. 
 

I’ve been told that applying for a tourist visa would be an automatic denial because he’s actually eligible for a marriage visa. Is it worth at least trying?

That is incorrect.  Where was that misinformation posted?

 

The chance of approval is based on the applicant's demonstrated strong ties to his/her home country.  History of travel and adhering to other country's visa terms (no overstays or other violations) also helps.

If you have $160 to waste, go ahead and apply.  Your chances of success are based on his ability to overcome the assumption that he will want to stay.

I would apply since you do not plan to move back to the US at this time.  As other’s have said, there is no guarantee he will get a B2, but it is worth the effort IMO.
