Hi All, 

 

Question for a section form I-485. See attached picture below. (Page 5, Part 4 of the document).

 

There is a question for Dates of Residence. In our situation, we will be adjusting from within the USA (B2 visa holder, circumstances changed and now adjusting with US Citizen spouse).

 

For address history outside the US:

 

What would the date be for section 8.b? The "To"?

Dates of Residence:

From:

To: ???

 

Need a clarification to that question so I understand it correctly.

Would the answer to this be the last day physically present at that address? Because at this point (AoS application), that would be the last day at the address?

Honestly, I would use the date when you decided to take the AOS route.  To me that is the date your spouse decided to end their residence at their previous address.

Thank you for your response. Follow up question. It says “Physical Address 2”. 

I am interpreting as… spouse was physically present there at the day of exit and has not physically returned since then (AoS now). Is it okay to think that way?

If I remember correctly, on form I-485 you have to provide the address for the last five years, correct? I think that you go by the most recent one (physical address 1) to the oldest one. So on physical address 1 you would input the address you have now in the US. And then on the date “from” I would put the date when you decided to AOS. Physical address 2 would be your last address outside of the US, and I would put the date you decided to AOS as the ending date. Is that what you are asking?

Yes that is what I am asking. I wanted to really understand what they meant. If it meant last day of physical presence or day which decision was made to AoS?

 

I wish the forms were more specific.

Well, I came here on an F1 visa, then years later met my now husband. I think for address 2 (my last address in Argentina) I put my flight date as an end date. To be honest with you, I don’t think they are going to be nitpicky about the exact date.

FROM F1 TO AOS

October 17, 2019 AOS receipt date 

December 09, 2019: Biometric appointment

January 15, 2020 RFE received

January 30, 2020  RFE response sent

Feb 7: EAD approved and interview scheduled

March 18, 2020 Interview cancelled

Hmm yes I see. Both points make sense to me. Last physical address at the time was the day of exit. 
 

On the flip side, last day of residence can be the day AOS was decided. Respectfully, I am a bit confused on the matter. Is this date something that will be scrutinized?

I think you’re way overthinking it. For your current address, you’d put PRESENT on the “to” field because you’re still living there.

I’ve never seen something so trivial cause any issues. But I’m not an IO.

Yes. I meant what should be on “To” in the previous address. Day of exit or day of AoS… I am confused on that.

Like I said, I put day of exit and I was approved without interview

If you’re adjusting status it means that you’re in the US already. Therefore, the “to” of your previous address should be prior to your entrance to the US

No. But I understand where @Dashinkais coming from and I respect them.However, to me, that would contradict with what your I-94 says. But that’s just me. I like my documents and dates to match the reality. Consult with attorney
