Unclear about AOS or Spousal visa

I noticed in your timeline it looks like your process took from Jan. 2017 to August, 2021?  That's a long time but it looks like you didn't take any action for a while.

My CR1 process was from January 2017-January 2018

Removal of conditions from December 2019 - August 2021

Citizenship from July 2021 - March 2022 

 

When one enters on a CR1 visa, they are given a 2 year conditional residency (2 yr green card).  You then apply to remove the conditions and will receive a 10 year green card.   

Visa - CR1

Service Center - Nebraska

PD - January 26, 2017

NOA1 - January 31, 2017

NOA2 - November 3, 2017

State Department - Sent November 7, 2017

NVC Received - November 9, 2017

Consular Interview - January 5, 2018

Port of Entry - Miami on January 19, 2018

 

ROC Mailed - December 14, 2019

ROC Rec'd - December 16, 2019

E-Notification - December 19, 2019

ROC sent to National Benefits Center (MSC receipt #)

OP's partner is already in the US, so the topic is about adjusting status without a CR-1.

Right, AP and EAD are taking around 8 months now.

 

You can find out your local field office on the USCIS.gov website - I believe there is a zipcode based dropdown.

What type of visa did your partner use to enter the US? 

Generally B1/B2 visas are issued for 5 or 10 years (multiple entry)

and I believe ESTA is valid for 2 years (multiple entry). 

 

Did they enter on another type of visa?

Thanks everyone for your replies so far.  For some reasons, we could not do the wedding and submit the AOS application before my fiance's visa expires.  I read before that this is not so much of a concern except the small chance that my fiance could be detained for overstaying her visa.  But we also need to travel before our wedding.  Will it be a problem to take flights with a visa that is past due?  Would we be better to stick to other forms of transport?
