The filling fee for VAWA is free. However if you are gonna send i-485 with that then you have to pay $1225. If you can not pay then you need to file for fee waiver.

RFEs are issued for 87 days normally from the filing date, due to the pandemic USCIS automatically extended every RFE issued between March 1, 2020 and July 25, 2022 for another 60 days.

 

So the deadline on yours would be 147 days after May 24th, so October 18th.

Hi @Demise , I am stuck regarding this RFE that was lost somewhere. If you recall, my VAWA was approved in Nov 2021, and my I485 is pending, its in St. Louis field office since Feb. My lawyer got a I693 deficiency notice in Feb 2022 that they never told me about till last week. Senator Durbin's office sent congressional inquiry on I485 last month, and USCIS responded last week that they sent an RFE on 5/24/22. I am assuming its for medicals, since that was the only missing info in I485 packet. My attorney's office is my safe mailing address on the I485, but they say they did not get the RFE. I didn't get anything in the mail either. I check mail daily. USCIS online portal doesn't have any update on RFE being sent either. I suspect the attorney has some mail issues resulting in the lost RFE, but I don't have any way to tell for sure. Attorney suggested that I request Senator Durbin's office to have USCIS fax a copy of RFE to them, but Durbin's staff refused to do this. They say this type of request is "outside their purview" and that they can only send "an inquiry regarding non-receipt of RFE", which I assume will take another 30 to 45 days before its answered by USCIS. I am running against the clock. I scheduled an immigration medical exam for tomorrow, but obviously can't send it without the RFE. Do you have any ideas on the optimal course of action here? How do I get a hold of this RFE in a timely fashion? Any others in the forum please chime in if you have had similar experiences or have ideas. Thank you.

On H1b status since 2014, H1b 6 years expired in May 2020. Out of status / Period of authorized stay since then. 

Amended EAD petition to C9 and filed expedite request for same in mid-may 2020. 

C9 EAD approved June 4, 2020. 

Biometrics done in Oct 2020. 

I485 case transferred to NBC for "faster processing" on September 30, 2020

Filed C9 EAD / AP Renewal petition in February 2021. 

Initial Advance Parole (from Feb 2020 application) approved in June 2021. 

C31 EAD production update - Nov 1st, 2021. 

C31 card delivered to attorney's office on Nov 8, 2021. 

I-360 case approved status update - Nov 22, 2021. 

No RFE throughout.  

Senator's office confirmed via congressional inquiry that the St. Louis office has received the I485 file and is currently awaiting interview scheduling - March 7, 2022

C9 EAD renewal card production case update - July 20, 2022 (took them just 17 months to process)

C9 EAD / AP renewal approval case update on both cases on July 21, 2022.

Combo card delivered to attorney's office on July 27, 2022

Medical exam RFE Drama: Second congressional inquiry sent in early July 2022 for I485. USCIS responded on 8/12/22 to this congressional inquiry that they issued an RFE on 5/24/22 and were waiting for my response. My lawyer denied receiving RFE and there was no such update on online USCIS portal. Lawyer's old firm was safe mailing address on my case. Lawyer changed firms a year after I hired her but did not change mailing address for my case with USCIS, she said she had a deal with her old firm to forward all her clients' mail to her new firm. Old firm denied receiving RFE. Sent another congressional inquiry requesting copy of RFE on 8/17/22. I also got medical exam done on 8/17/22 as I assumed RFE was for medical exam (thanks for this forum's insights.) Yelled at lawyer and threatened her with dire consequences. On 8/18/22 my lawyer's old firm finally found scanned copy of RFE in their "archived scans" (whatever the duck that is) and emailed it to me. It was indeed RFE requesting medical exam. On 8/20/22 I mailed medicals sealed packet with copy of RFE to St. Louis field office. Also sent a notarized letter with the packet - updating safe mailing address to my home address and informing St. Louis field office that I fired my lawyer. Sent similar letter to Vermont Service Center on the same date. 

8/23/22 - Fedex confirmed delivery of medicals packet to St. Louis Field Office. 

8/26/22: Case update on I485: New Card Is Being Produced

8/29/22:  On August 29, 2022, we approved your Form I485, APPLICATION TO REGISTER PERMANENT RESIDENCE OR ADJUST STATUS

9/3/22 green card delivered to attorney's office (they didn't change safe mailing address despite my written requests to FO AND VSC.) 

9/6/22 VSC returned AR11 and my letter requesting safe mailing address change. In their letter they said something to the effect of "you can do this online, we wont do it via snail mail request etc." Just posting as an FYI, its weird. Also received I485 approval notice on the same date.

Hi 

Nothing is sure it was for the medical. 

Because you should have had an update for a RFE sent on your case status. 

That's why I guess it should be something else than medical. 

Continue the follow up with your congressman an do not over stress for the time. They are aware from your congressperson inquiry that you did not received any RFE

Relax,....your case status should have been updated if it was the medical RFE

I also think it should be a RFE for medical. 

1- your case was already approved 

2- the case status was updated to " we sent you a RFE.."

I experienced it 10 days ago.

Reach out to your congress person for help. Last year i helped someone to get the RFE through congressperson that uscis send to her and she didn't receive it. However congressperson was able to got that for her.

As a GC holder, you do not need anything else other than your valid passport and Covid-19 requirements of the country you are visiting in other to travel.

So did they re-send it to her or did they send it to the Congressperson's office? How did they send it - snail mail / email  / fax? And how long did it take from congressperson sending the request to USCIS to obtaining the RFE? I contacted a congressman's office today and they will send the request to USCIS tomorrow. They said there was no guarantee USCIS will send it to their office electronically (email/fax) and it could take as long as 6 weeks for a response. I am worried about time due to the deadline issue. RFE was issued on 5/24/22 and although @Demise assured me there was time to respond, I want to avoid any further delay. And of course I am tired of waiting for my GC.

we got the response within 3 to 4 weeks. USCIS did send an email copy to congress person. 

Have you thought about going to your field office. make the info pass appointment that might help.
