Now on my n400 I put her because all the documents have her on it.

Did you apply for N400 as a 13 year old or adult?

If adult - no excuse for your lie in the eyes of USCIS.

If you gained your citizenship through your stepmother - you're risking getting it revoked.

Sir you didn't understand my point. All this happened when I was 13 years old. All of my documents gave her as my mother. I didn't lie I was a kid. Now on my n400 I put her because all the documents have her on it.

Lastly I don't understand your question about the beneficiary. All I know is that her name is on my documents.

I really don't know about this situation that's why seeking answers.

You are not responsible for what happened when you were 13.  You didn't lied when you were a kid.

You are responsible for what happened when you were an adult and filed the N-400.  You did lie when you were an adult.  That's the point you don't to seem to understand.

Who's the primary beneficiary is important.  Was the US relative that brought your family to the US related to your father or stepmother?  This is important even if you don't understand why in order to answer your questions.

If you became a permanent resident through your father, your problem is not AS HUGE, but it is still bad.

It seems you applied for citizenship as an adult and you should have corrected the information regarding your mother.

You can try petitioning your mother and as she does not appear on your birth certificate you'll be required to provide DNA proof that she is indeed your biological mother.

Now, what I don't know is how much your father's decision will affect you, as the birth certificate you've been using all these years is basically a fraudulent document.

You could have fixed this if you hadn't lied on the N-400.

Listing your stepmother on the birth certificate was a misrepresentation but not a material misrepresentation since your USC or LPR father could have filed for you.  (Was your father an LPR and filed for his wife and her derivatives?  Listing her as your mother saved your father from filing separately for you?)

You listing your stepmom on your N-400 as your biological mom is the fatal mistake.  This is where you screwed up.  Instead of fixing a birth certificate that you knew contained false information before submitting your N-400, you willingly and knowingly submitted a birth certificate containing a lie that you told the US Government was the truth.

No way to petition your mother without you admitting that you lied on your N-400 application.

Yes I got my citizenship through my father not my stepmother. She's yet to be a citizen.

Thank you for the replies. BUT I didn't lie because I didn't know. N400 was filed earlier and he just submitted with all other documents from the begging.

I became a US citizen in 2011. I was still a minor.

I asked if you filed an N-400 for US citizenship.  You should have said no.

You got derivative citizenship as a child.  You never filed an N-400.

Fix your birth certificate.  File for your mother.  Have a REALLY GOOD REASON as to why your birth is a late registration.  Prepare for a DNA test.  I suggest that you seek a US immigration lawyer to help you.

Which is it?  You got US citizenship as a minor or you filed an N-400 to naturalize?  You couldn't have done both.

Who did you list as your mother and swore to the US Government that was the truth?
