How do You legally change your and your spouce name with a marriage license from Utah?

I bought our marriage license yesturday for an utah zoom wedding and the clerk told us that after we get the certificate we go to the DMV to change our name. But I'm not sure how that works? I'm from NY, in NYS it says you put your desired new name at the wedding ceremony for the certificate. Am I too silly in the head or things aren't exactly clear?

 

Like, for example. If my name right now is Alpha bravo charly delta (mothers maiden name) i want to change it to alpha bravo delta, my fiance wants to do the same because we both want to remove our perspective fathers surname. She may or may not want my mothers maiden name as her new last name.

No,  I married my late husband in NYS

certificate has my maiden name and his full name 

with our DOB's and place of birth and current addresses 

 

this is because no one is required to change their last name

you can put the new name on the application but maiden name will be on the actual marriage certificate

and u use the marriage certificate to change the surname at the DMV

So just to follow up on this because i'm super unfamiliar with it, i don't know anyone that has changed their names here.

1) we get married and the marriage certificate will have both our first names and both our fathers and mothers last name.

2) So long as we use that marriage certificate with all of our names we can decide to mix and match the last names how we want going forward? So I can be my first name, middle name then Mothers maiden name just like that ?

3) We can File the I-130 with the new names ? or do i have to go through the SSC first/get a new passport? new drivers license etc? or they'll accept the marriage license even though all my other ID's will say a different name ?

Forget about what you would do in NY if you married there.  You didn't marry in NY.  If you married in Las Vegas, you would do the same thing to change the US Citizen's name as you would do if it's a marriage certificate from UTAH.  Just aside, don't confuse a marriage license with a marriage certificate.  They are NOT the same thing, even if sometimes they appear on the same page.

 

If the foreigner intends to change their name too, they'll follow the procedure in their country.

The certificate of marriage contains the following information: Surname (before and after the marriage), name, patronymic, date and place of birth, citizenship and nationality (if indicated in the record of the act of marriage) of each of the persons married. Date of marriage

What appears on a marriage certificate depends on which government jurisdiction is issuing it.  They are definitely not all the same.  In the OP's case he's talking about a marriage certificate from Utah County, Utah, which may be somewhat different in each county of that state.  Probably not but could be.

 

Unless you have an image of a Utah County Marriage Certificate, you don't know what it will show.

We do not handle name changes through our office. We will send you a certified copy of your marriage license, which should be sufficient proof of your marriage to any government agency. Name changes are typically handled by the Social Security Administration and the Driver’s License Division.

  • For more information on changing your name through the Social Security Administration, go to www.ssa.gov to learn more and find your local Social Security office.

You can choose to change your middle name and last name when you marry by putting the new name on the marriage license application. You can’t change your first name by marriage. The new middle and last names are officially yours when the marriage ceremony is completed. Your marriage certificate is proof of your new name and can be used to change your name on other identification papers such as your driver’s license.

You can change your last name to any of the following:

  • your spouse’s last name;
  • any former name of either spouse;
  • a new name combining into a single name all or a part of either spouses’ present or former last names;
  • a hyphenated name consisting of any combination or either spouses’ last name or former last names.

You should double check to see if you're able to change your name in New York State if the Utah Marriage Certificate does not show the new name you want to use. My country requires the marriage certificate to contain new name as proof of name change so if I didn't change my name when I got married I would have to change it by deed poll. 

 

Your partner in Colombia will have to look up the process for name change there and if she wants to enter the US with her new name. She should apply for a new passport bearing the new name before she attends her visa interview.

I figured reporting the marriage and carrying the license would suffice to identify her. What about for the I-130 paperwork? Her old ID's would still work correct? You thought wrong and are still thinking wrong.  If you use the married name on the I-130, the only thing she has to change in Colombia is her passport.  Who said anything about her other local ID's?  By using the married name and changing the passport, all future ID's will be issued in the married name.  What she does with other Colombia ID's is between her and the local GU's there.  Has nothing to do with US Immigration.

Her spousal visa will be issued in the name of her passport. Subsequently, her green card will be issued with the name of her passport.

If she wants to use a new name in the US she will have to update her passport.

Got it, thank you! Well get married and apply with the new name and have her change her passport along the process.
