Will Spouse have issues with I-864 at Interview

Greetings, so i filled out my DS-260 and I-864 at the End of December 2020 and got it doc approved in early jan 2021. so in the year of 2021, i went to India to live with my wife for 10 months, after 4 months my company wanted me to come back to the USA to work (I work a remote job), so i quit at the end of april. Will this have any effect on my wife's Visa Interview?

I have tax transcripts from 2020, 2019, 2018 which show my income is very much above the treshold but my income for the four months in 2021 is roughly 43-45k, should my wife take my W2 to the interview or is income for 2021 or is this not needed? I have a new job that i started which shows i roughly doubled my salary, but i just started this job, will the offer letter be proof enough?

 

Wifes Visa Interview is in a Week.

Timeline

Even though you  got approved you were approved for 2020 tax information this is now 2022 so you will need the 2021 tax information. I would upload it to ceac and take to the interview also if you got the interview letter it should have told you the papers you will need an update on. They are only looking at most recent transcript or w2s with follow up information $21,775 is the amount for a family of 2. FYI being we are working on 2021 you won't have that transcript so 1040,w2 paystubs and a letter for you 2021 filing. They won't go by anything just started.

It says to bring the most recent tax return and any relevant W2's, most recent tax return would be the year 2020, since 2021 tax year still hasn't finished. So i guess i'll let her take the 2020 Tax Transcript and my W2 for the year 2021, thanks !

Timeline

Sometimes COs go by what they already have even if the documents are 1 or more year old. However they may also ask for updated i864 and latest evidences of income. In that case you have to provide the latest documents. Be prepared than sorry.

Spouse:

2015-06-16: I-130 Sent

2015-08-17: I-130 approved

2015-09-23: NVC received file

2015-10-05: NVC assigned Case number, Invoice ID & Beneficiary ID

2016-06-30: DS-261 completed, AOS Fee Paid, WL received

2016-07-05: Received IV invoice, IV Fee Paid

2016-07-06: DS-260 Submitted

2016-07-07: AOS and IV Package mailed

2016-07-08: NVC Scan

2016-08-08: Case Complete

2017-06-30: Interview, approved

2017-07-04: Visa in hand

2017-08-01: Entry to US

so should i go in and update the i864 or just print a new one fill it out and take it to the interview?

Timeline

You should complete a new I-864 just before the interview.  Have it ready if the CO asks for it, but don't submit it if he/she doesn't ask. 

 

If the interview is after April 19 (I believe), then you will need the 2021 tax return information in the new I-864.  By that time you should have a few paychecks as evidence of your new current income.

you definitely have to do a new I-864  and upload it as well has have it for the interview but they see already what is loaded and what they need and being it's a new year but the embassy asked for my w2 1040 paystubs I didn't have a transcript for 2019 nor 2020 my dq was 2020 interview 2021

If the CO asks for lates paystubs or evidences of income, that may be a problem. Having been unemployed for last 8-9 months and having just a job offer right before the interview might be perceived as if the new job offer was simply created for the interview purpose. The CO has the full discretion in that.

Good to know but I have tax transcripts for the past 5 years and I have enough assets to cover myself even if my income was 0
