HI ALL,

as we all wondering why our i-130 is got approved and i-129f pending. I called USCIS. they said that if your i-130 approve before i-129f then i-129f get abandon. I called 6 or 7 times to USCIS just to get the confirmation. All reps told me the same thing, that if you in k3 visa i-130 get approved before i-129f then i-129f is no longer valid.

Did anybody got approval for last month for both applications?

Sometimes they announce after the fact, when it has already become apparent what has happened. I think we need to have a little more time pass for it to become clear what might be happening.

I would not find it surprising if the USCIS has implemented such a policy. I believe that it would be justified under the law that created the K3 visa. The stated purpose was to allow a spouse to enter the USA as a non-immigrant while the I-130 petition was pending. The original problem having been pretty much solved - it's no longer taking more than a year for I-130 to be processed in most cases - the K3 visa process no longer provides the benefit it was created for.

I'm fine with this as long as they refund my fee! Yeah, right! Like that will happen!

Wife's visa journey:

03/19/07: Initial mailing of I-129F.

07/07/11: U.S. Citizenship approved and Oath Ceremony!

MIL's visa journey:

07/26/11: Initial mailing of I-130.

05/22/12: Interview passed!

This is very well possible. My I-130 was approved about 3 months ago and there has been no touches on my 129F since May 7. Before my I130 was approved, I had numerous touches on my I129F but it does seem as though my I129F has been abandoned. If this is in fact the case, why isn't USCIS announcing it? Are they just trying to get the money from the I129F filing fees?

Jan. 15, 2007 - Got married in India

Feb. 02, 2007 - Sent Form I-130 via Certified mail

Feb. 05, 2007 - NSC Receives Form I-130

Feb 07, 2007 - NOA-1

Mar. 15, 2007 - Touched

April. 11, 2007 - Touched

April 17, 2007- Approved!!

May 01, 2007- Touched

NVC Processing of I-130

April 27, 2007- Received by NVC

May 14, 2007- IV Bill and AOS fee bill Generated

May 22, 2007- Sent AOS fee bill

May 27, 2007- Received AOS fee bill in mail

June 11, 2007- Received I-864 package in mail

June 14, 2007- Still no IV bill. Called NVC so that they can resend it.

June 18, 2007- Sent completed I-864 package

June 22, 2007- Still no IV bill

June 25, 2007- Finally Received and Paid the IV bill!!

August 05, 2007- Sent DS-230

August 21, 2007- Case Completed at NVC

August 27, 2007- Case Forwarded to Embassy

October 15, 2007- Interview!! Visa approved!!

I'm fine with this as long as they refund my fee! Yeah, right! Like that will happen!

Surely, they won't refund your money ($170.00). Yes, K-3 is not providing the benefit that it was created for.

I-130 Timeline with USCIS:

It took 92 days for I-130 to get approved from the filing date

NVC Process of I-130:

It took 78 days to complete the NVC process

Interview Process at The U.S. Embassy

Interview took 223 days from the I-130 filing date. Immigrant Visa was issued right after the interview

Every day something new about USCIS..I really was expecting 129f to be aproved soon..It's faster way to be together..instead of abandom 129f they could send aproval and let us decide what way to go.. for Example I need to go to other country for immigrant visa interview.and it aslo takes lot's of time to complete the case. :angry: where is justice ?? if they are really need to be suported then can ask for it or at least give us possibility to buy the faster process..anyway all of us paid enaugh and still expecting for miracles..they don't know the taste of being separate from wife/husband.. :(

I had questioned my congressman office about when the I-130 is approved before the I-129F. But, can someone explain to me for entering the US as an immigrant rather than a nonimmigrant. If they enter as an immigrant I guess we do not have to change the status. I'm confused. Can someone help me on this?

Also, here is their response:

The K3 visa (I-129F) was created to help reunite families more quickly than the immigrant visa (I-130) process usually permits. Many of the I-130 petitions have been transferred to other Service Centers to reduce the processing time on these applications. Many I-130 petitions have been processed more rapidly than anticipated.

If your I-130 petition is processed more quickly than the I-129F, then this is good news. If your husband has his I-130 interview before his I-129F interview, then that is good news. It means he would enter the U.S. as an immigrant rather than a nonimmigrant.

I will continue to monitor your applications. The California Service Center states in emails to me that they process everything within 6 months of receiving the application. I am seeing them move more quickly than this.

I cannot at this point give you a more accurate estimate of timing on either petition. It is a very fluid situation within USCIS as they seek to process all application types at all Service Centers as quickly as possible.

I would never trust what USCIS information tells you. My I-130 was approved a month before my I-129 but we still had our K-3 interview go through. The CR1 still takes longer than the K3 because of the processes with NVC. Another thing to ask your consulate is interview dates based on what type of visa recieved. CDJ said 30 days from time of receipt on K visas and 9 to 12 months on CR1. Why this is I do not know. The NVC issues different case numbers to your CR1 and your K3. I wonder if USCIS isnt sending K3's to the NVC if they have an approved CR1?

Have you filed everything with the NVC yet?

From this email they stated appointments for each but not applications for each. They did not say that if one is approved before the other they would stop processing the one not yet approved?

Kim,

If your husband comes as a nonimmigrant on a K3, then you must go through AOS (adjustment of status to legal permanent resident), I-485. Processing times for this can be lengthy too (check timelines). Also, as of July 30, the new fee will $1015 for AOS. Coming on an IR-1/CR-1 means he gets his green card, no AOS to wait for.

05/12/2007 - NOA1 received by snail mail after a loooong wait

05/14/2007 - Sent I-129F for K3 to Chicago Lockbox via USPS Express Mail

10/22/2007 - I129F APPROVED (161 days), I130 APPROVED (188 days)

11/08/2007 - I129F received at NVC, embassy case number generated.

11/13/2007 - I129F forwarded to embassy.

11/18/2007 - 129F petition received at embassy

01/09/2008 - finally, DOS gives me the interview date, April 16, 2007 (ouch)

Adjust - not change - status. You are correct, if one enters as an immigrant they do not need to adjust status - they have immigrant status already.
