Hello,

 

So, I am on F1 status and just submitted AOS based on I-130, just got the receipt notice within a week. I have two questions.

 

1> I only need 5 more credit hours to graduate however, I have to attend class in person for 1 Credit as it is activity based and not offered virtually, and my university is about 5 hours away from where we live. So is it ok to just fall out of status? The reasoning behind this is on I 485 I said "I have violated terms of my non immingrant visa by unauthorized work", and let's say hypothetically, if I were to get denied on AOS I would still be out of status as USCIS would conclude that I violated F1 and thus terminate my sevis even if I was in school and maintaining my status. Am I thinking this correctly?

 

2> My wife, who is a us citizen is planning for interntional travel to attend her sister wedding, and could stay there for about 2 months. If i were to get interview scheduled and the date falls in the range when she's out of country. Can I get it rescheduled or not?

to spend all that money and not finish?

take the needed course at a local college and transfer the credit as we would do if going to community college and then transfering to a BS college or university

then ,  u will have that degree

I don’t understand: why would USCIS determine that you violated your f1 status?

Feb 7: EAD approved and interview scheduled

June 15th, 2023: Case actively being reviewed

August 30th, 2023: Interview!

August 31st, 2023: Oath ceremony scheduled.

Sept 19th, 2023: Officially a US citizen!

Well, On I-485 there is a question "Have you ever worked withour authorization and Have you violated terms of your non immingrant visa" since I worked withour authroization that is a violation of F1 status. So I said yes to both that might show them I have violated F1 status.

I understand that but colleges around me had a deadline in november to apply for spring 2022 sem. And I don't know if I would still require full 12 credit hour course load.

 

But what do you think about my question 1?

Why don't you talk to your college advisor or an advisor for the course work you need to complete to graduate? 

 

Colleges are very flexible if you talk to people and make inquiries.

You can but sometimes it's difficult  to reschedule or there's not enough time. You'd need to be on top of it.
