Please help. Denied entry to USA - can only apply now for B2 visa

Hi there, thank you for giving your time to read this.

I was recently denied entry to the USA as I admitted to working for a month without authorization on my previous visit. I was told that my VWP is cancelled, sent home on the next flight, and if I want to come back, I have to apply for the B2 visa here in the UK.

Now that I'd like to apply for the B2 visa to visit family and friends, what are my chances? Do you know anyone else who's been in my situation and managed to come back on a tourist visa?

During the pandemic, I was on furlough leave meaning grounded from work. I came to the US to enjoy my rare few weeks off. Anyway, that didn't turn out well. But my circumstances has changed as work has resumed, and I can at least show the CO a more detailed plan. I only have 2 weeks of annual leave coming up, I am getting paid again and I have to report back to work after the weeks on a certain all of which I can prove on paper.

I am asking objectively that with my new circumstances which is considerably different from the previous time, is it still worth trying?

You can certainly apply, with your recent history probably be a waste of money now. Concentrate on building your ties and be able to show a solid case in a few years.

I was thinking that too. Continue doing my job and avoiding any trouble for the next 4-5 years and then probably apply then. I'll also speak to a lawyer and see if he/she believes this the best way to go.

Unfortunate choice.

 

A lawyer cannot help, and will be a waste of money.

 

Best bet is to wait a solid period of time (5+ years) before applying for a B visa.

You can certainly apply for a B-2 but the admission above certainly will lead to a B-2 denial. They don't take violation of visas lightly.
