Brandon is out there telling companies to ignore the courts though. Even if this gets overturned and goes away many people were already coerced into getting the shot as they feared losing their job. The damage has already been done to a certain extent.

Reading the actual rule and the response by our current dictator, this is not a surprise.  The rule was written is such a hurry by an organization more used to working at a snail's pace, and the full court press by the administration along with their attacks on the court pretty much telegraphed the narrative they are trying to create.

Extending Its Stay, the 5th Circuit Says OSHA's Vaccine Mandate Is 'Fatally Flawed'

The court adds that "the underinclusive nature of the Mandate implies that the Mandate's true purpose is not to enhance workplace safety, but instead to ramp up vaccine uptake by any means necessary." That is in fact how the White House presented the mandate in September. The aim, it said, was to "reduce the number of unvaccinated Americans by using regulatory powers and other actions to substantially increase the number of Americans covered by vaccination requirements."

 

The petitioners argued that workplace safety was merely a pretext for accomplishing that goal, and the 5th Circuit is clearly inclined to agree. "After the President voiced his displeasure with the country's vaccination rate in September," Engelhardt says, "the Administration pored over the U.S. Code in search of authority, or a 'work-around,' for imposing a national vaccine mandate. The vehicle it landed on was an OSHA ETS."

Makes a lot of sense.  For some reason I am not seeing a lot of folks defending this "Old Joe" action on legal grounds.

 

OSHA Halts Enforcement of Biden Vaccine Mandate, Pending Litigation

 

The Occupational Safety and Health Administration (OSHA) will not enforce the Biden administration's COVID-19 vaccine mandate, at least until the mandate's legal status is resolved.

 

The announcement came on Wednesday. OSHA's website now stipulates that while the agency "remains confident in its authority to protect workers in emergencies, OSHA has suspended activities related to the implementation and enforcement of the [COVID-19 Vaccination and Testing Emergency Temporary Standard] pending future developments in the litigation."

 

The U.S. Court of Appeals for the 5th Circuit halted Biden's vaccine mandate, which applies to all private businesses that employ at least 100 people, last week.
