Hi all, 

I am about to send a request letter to  USCIS to convert my i751 filed joint into a waiver divorce. So me and my ex are still living in the same apartment, we have a lot of bills and we are trying to help each other financially. Is that going to cause any issues to USCIS since we don’t live separate? Thank you for your help

Uscis doesn't ask what ur ex is up to post divorce or you are not going to volunteer that to uscis, are you?

Of course I will notify USCIS for the divorce. I was just wondering if is okay if we still live together even if we are divorced. But thank you anyway for your answer.

I meant you were not going to volunteer telling uscis that you and you ex are still living together.

I am not gonna lie about that of course. My concern is if that’s gonna cause any problems , if yes , I would rather move to another place then.

I don't see why that would be an issue, you need to prove you enter into the marriage in good faith and you were a bonafide couple up to the legal separation and devorce. You being roommates with your ex spouse should not be an issue.

Right. That’s what I thought. I heard a lot of couples get divorced but still live in the same house, just to help each other financially but I just thought that’s gonna cause some issues with USCIS. I wanted to make sure, because I would rather move to another place if that’s an issue.

If as you say, you both live together, you have a good relation, and you try to help each another, why doesn't stay together a little until you have your interview.

Well we get along as friends but not as a couple.

Yeah not really an issue, all USCIS care for is that your divorce is finalized and your marriage was legit / good faith. 

 

I'm still financially tied to my ex in a lot of ways (not through choice), that's just a reality of marriage and the divorce process. I personally couldn't live with my ex, but if it works for you.
