Hi All,

 

I'm in the UK currently as the applicant for an IR1, currently my application is with the NVC.

 

Last night we had an email notifying of an RFE, when logging on to NVC we had messages asking for the 1099 form for both my spouse, and my sponsor.

 

12 Hours later, we had another email informing of an update, and now when I log on the status of affadavit of support is 'Accepted' for sponsor and spouse, and just 'Submitted' for my civil documents section at the bottom.

 

So, my questions, does this mean the reviewer realised they didn't actually need the 1099, and the AOS is now accepted without an RFE? Will my civil documents be reviewed quite soon after the AOS, or should we expect another wait?

 

I am planning on confirming with NVC over the phone, but we sat on hold waiting for an agent for about 45 mins yesterday while on my lunch break and don't know if i'll be able to get through today or not.

 

Appreciate any advice/experience!

We have already uploaded the tax transcripts; we thought maybe they had requested the 1099 as my financial sponsor filed jointly with her husband, but we are only using her individual income for sponsorship. (My wife was also in the UK during 2020, so we submitted the tax transcript which showed no tax paid etc.)

 

I don't believe we have uploaded 1099's previously.

 

I have submitted an inquiry form, as I can't get through to the phone line at the moment, i'm hoping the 'Accepted' does mean that they are now reviewing my portion of the application and have moved on from the affadavit of support.

A joint tax return transcript would not show the individual income of your joint sponsor. Did you send something else to prove her separate income like an employer letter or six months of pay stubs?  Or did her spouse complete an I-864a to authorize his share to go toward the sponsorship?
If it changed to ”accepted” then it sounds like you did provide something to verify her personal income. Or maybe the NVC agent is just new and confused.

Yes, all kind of confusing, but it is best practice to provide an I-864a from a married joint sponsor, no matter what the spouse's income is or whether it is necessary to qualify.  The affidavit of support is more of a contract than it is a statement of financial qualification.  

Facts are cheap...knowing how to use them is precious...

I've looked now, we submitted W-2 and tax statement, tax transcript then other documents like the AOS form.

 

We didn't submit the I-864a as we are not using the spouses income in this sponsorship.

 

Wasn't able to get through on the phone to check again yesterday, although 'accepted' does seem to signify that they have cancelled the need for the 1099 forms.
