Our visa interview was a complete nightmare. My husband and I have been together for 13 years and i brought pictures dated back from 2011 til the present as well as bills showing our address has been the same since 2012 when we Bought our house. I brought all I could that the lawyer told me to bring and provide, but to say the lawyer didn’t prepare us is an understatement. 1st he should have given us a list of all the questions we could be asked so we could better be prepared he only went over maybe 6 Questions, then even during questions that was way inappropriate the lawyer didn’t even speak up, he was no different than a fly on the wall would have been. He didn’t even write down the interviewers name so we could file a complaint if needed and in this case it’s needed. First the interviewer didn’t even write down any of our answers we provided or type them in, and you can’t memorize someone whom you just met answers. 2nd the Questions he asked us were conflicting he ask me has my Husbands family visited our home and ask him has my family visited our home and then wrote on our NOID that the answers didn’t match, well ofcourse you can’t match answers to different questions. Next he asked me where exactly Nelson was working out of town in March 2020 a yr and a half ago Nelson travels constantly to different states and jobs as a roofer I told him I can tell u every state he worked in but I can’t tell u what week he was where. He asked Nelson in the last 3 years what was your 3 largest jobs Nelson said I worked in Michigan for 8 months and Florida for 4 months the interviewer wrote on the letter that from June 2020- feb 2021 he worked in Michigan for 8 months which isn’t true he didn’t work there at all in 2020 the tax returns proves that so again he is writing down answers that weren’t the answers or answers to different Questions. He asked me what I did for Nelson’s birthday this year in which I answered 5 times Nelson is rarely home on his actual birthday day but I give him a card and cook him dinner meaning I give him those things once he gets home that weekend Nelson answered he was out of town working which is what I said numerous times and this is another reason why he should have been documenting our answers and asking the same questions. There was many many more results in which he is saying false facts and not asking us the same questions some times they are way different questions which is a real problem. Then I find out from other lawyers in our area that there’s been many issues with the Charlotte N C office where they were doing this same thing to other couples. The sad part is the interviewer is Latino so he has more than likely went through similar situations or someone is family probably has which makes this extra wrong. My husband and I have been together since 2008 our relationship is 100000% real I get that others has abused the System and they have to be cautious about who they give a green card to but there’s a difference between those people and someone who has pictures together with you and your family since 2011 and it is showing that date on the pictures, no all our bills aren’t in both of our names but there’s some and then there’s others that’s in ones name and the other person is the authorize user. But to have all those false statements on the NOID. How to you respond in a way to defend yourself without angering the man and he denies you. That is an extremely unfair place to be. I am getting together lots of proof if he wants it he’s gonna get them so I have printed off bank statements from the last 18 months where I went back and highlighted in different colors for different categories. I also printed our tax forms again to prove he never worked n Michigan last year I also printed off our bills and the Proof were authorized users I got 6 more support letters from people who witnessed our relationship I copied all the cards we’ve gotten for each other and I also went back to 2011 in Facebook printed all posts referring to our relationship cut them out put them in order from earliest to most recent and im

not sure what else I can get but please if anyone has any more ideas please let me know and if this doesn’t work then I will most definitely be appealing and after that considering this seems to be a common occurrence for this interviewer I will be filing a complaint and I feel he shouldn’t be over peoples lives it’s not right he can go be a secretary or work at McDonald’s if he can’t be unbiased open minded transparent professional and respectful then he doesn’t deserve the right to be in a position where he plays God Period and I will try everything possible to make sure he doesn’t do this to any other couples but what I hear is that there’s some serious problems with the Charlotte office it sucks we had to go to that one and that we got that interviewer on top Of that who lied and I think had his mind made up before we even met him but I won’t lay down and just say ok I accept my husband being denied NOT A FREAKING CHANCE(: he got the wrong woman this time because I will fight for my man and the only dad my kids have ever really had in their Iife since they were little. Nelson has always been here legally on a work visa since 1997 and it’s not fair he’s being treated like he’s not truthful and our relationship is completely real it’s a shame when people whose arent gets approved No problem and peoples who is does not that makes no freaking sense at all. I pray I’m able to show with a mountain of More documents that we are in love and are in a committed relationship fingers crossed but this is really frustrating in so many ways  🤬🤯😳😤🙄🤥

Sorry to hear about your bad AOS interview experience, it is definitely not the norm.  From the description of the questions the officer asked, and the answers given, they are most likely concerned about the months you were living apart, when your husband was working out of state.  A tax return is not proof of where your husband was working.  You can appeal the decision, which will take a long time, or file a new AOS package with your additional evidence.  I would recommend the second option because appeals can take longer.  When you send the supporting evidence, focus more on financial co-mingling documents than photos, Facebook pages, and affidavits from friends and family, which are weak.  Send all joint bank account and credit card statements since the date of marriage, joint health insurance, tax return transcripts, will, living will, power of attorney, mortgage records, deed showing joint ownership of property, joint auto loans, auto insurance, auto titles in both names, both of your driver's licenses showing the same address, etc.  Gather this kind of evidence since your marriage date.  Good luck!

That’s the thing we haven’t lived apart since we bought our house in 2012 he used to work out of town for the week or some of the week and then came home on the way back on the weekends but now he works for a company that works closer to home so he doesn’t work out of town that often but he’s always resided at our House we live one street away from my moms house. As far as his tax return proving he didn’t work in Michigan this is what the man is saying Nelson answered which he didn’t he never would have answered that he knows what states he works and his job give him a w2 for every state they work even if it’s just for a day so we do have proof he didn’t work in Michigan I meant w2 not tax forms I apologize for the confusion so we don’t live apart we never have he stays in hotels when they go to work jobs in other states and he shares a room with the other crew on their team but after 12 years he changed companies so how he’s home more often and has been for the last 5 months Nelson has always worked roofing since we met so this is how our life has always been, his choice in work should not dictate wether our relationship is real that’s my opinion anyway. And I am doing just that so far I have a paper dated in 2015 showing I’m an authorized person on our mortgage I printed off a years worth of Bank statements and I went through them and highlighted the different categories showing that even my credit cards me being the primary and my husband the authorized person that it still comes out of that account same with our Duke energy bill it’s in my name but comes out of that account for also printed off all the payments in the last year on my Duke login page so they can match them up to the bank statements I printed off my credit card bills and where it shows Nelson is an authorized user I printed of our At&t account info showing it’s in my husbands name and I’m an authorized user same with Directv I gathered documents showing I’m the beneficiary on my husbands life insurance policy I got bills from our farm bureau car insurance all the way from 2015 showing my son and I are insured on Nelson’s policy same with our trash bill which is in both our names then I printed off the Facebook posts as extra proof and I have 6 support letters and I am going to address every part on the NOID letter the Crazy part is that I talked to the lawyer yesterday and asked how I should start the letter how I need to word it because although the interviewer is a liar unfortunately he is because he chose to put false info down on that letter so he’s not being truthful or he mixed our answers up from other Questions which wouldn’t have happened if he wrote them down but the thing is my lawyer said we already discussed that I need to focus on printing our texts and get more pictures which I do not agree I feel like I’ve already provided pics I need to thoroughly address that letter if it were already discussed then the man wouldn’t have put them in the letter and what I have read is that u need to Address every point on there if you have 10 things and only address 9 that one thing could get you denied I am beginning to think that lawyer isn’t a very good one because his advice isn’t what I’ve gotten from all other lawyers or online so I would think that the many are right and the one is wrong I feel like this is why we weren’t prepared for our interview he didn’t tell me that when I’m just an authorized user on an account that proof is valuable I just feel frustrated this is our biggest last shot before we get denied and we have to pay more money with a different lawyer ofcourse To file an appeal so it needs a o be perfect I was trying to ask how I should word my Affidavit I don’t want to make the man mad and him deny us because of that I heard from a lawyer yesterday that they have been having problems with the Charlotte office denying cases with great evidence and interviews who have been together longer than my husband and I have been together there’s been multiple complaints about that office doing exactly what they did to us not taking down answers asking different questions then saying they don’t match up or saying the answers are for another Question so that’s why I wanted the lawyer to tell me exactly how I should start that letter and how I say that those claims are false without being mean about it even when I feel like it but I can’t so I want to be thorough professional and make sure I have not only what I need for them but extra stuff as well the Facebook stuff and all that is just extra first I focused on getting the strut showing everything we have is together even on our Bank statements it says my name on the transactions over n over and also my kids names on some of them as well so what do you think about what I have so far and do you have any other ideas of stuff I could get together now that I have extra time since they extended our response time I am going to take a little extra time to gather more stuff and I don’t have to rush so I can make sure it’s perfect but I definitely could use some advice on how to work the rebuttal letter if you could help me with that and any other stuff you feel I should gather sadly I’m on my Own it seems because it takes days and days to get the lawyer to call back and when he does it’s kinda a waste of time talking to him he’s fixated on the 2nd and 3rd least important proof to gather not the Stuff they like to see the most. I think I need to stick to the 1st important evidence and then just put some of the other items in there as a bonus but don’t focus on that stuff until I got all I can from the other stuff do you agree with my approach? And I hope someone else can give me advice as well esp how to word that letter disputing his findings. Oh and I did provide our drivers licenses showing the same address i Even provided our social security papers dating back to 2012 for both of us with the same address as well as trash bills same address power bills car insurance back to 2013 with me as an insured person and then ones from 2015 showing my son was added as an insured person I provided tax transcripts the day of our interview I gave them to the man Myself but I went ahead and printed them off again so he can have another set I copied all the stuff I gave him last time just Incase he says something isn’t there I wanted to make sure he had Everything I can get neither one of our addresses has changed since we Bought our house in 2012 it’s in my husbands name because my dad ruined my credit I co-signed a second mortgage for him so that’s why I’m not on the account but I’ve always been a authorized person im glad I kept the paper showing that dated 2015 lol inorder to add me to the account we would have to Refinance the house and we can’t do that right now but let me ask you one More question my parents actually financed our heating a/c unit a few years ago when ours went out we had recently got a car a house and a water system so we couldn’t get approved then so my mom and stepdad did it and we pay the bill it comes to our house should I provide that as well? I appreciate all you told me so far please let me know how you think I’m doing so far and about the Questions I asked. Thanks

What’s wrong with working at McDonald’s? Are you suggesting McDonald’s employees are unprofessional, biased and not respectful?

I’m sorry that you went through this experience.

Not at all I’ve worked at McDonalds all I’m Saying is that if you can’t do that Job with a complete open mind, not have your mind up prior to meeting someone and  are biased you should work elsewhere your not over someone’s life by working at McDonald’s yeah you have to be respectful towards the customers but that’s the only thing your in control of, not wether someone’s husband is ripped away from them or stepdad away from the only far my kids have ever known they just meed

to work somewhere where their actions does not determine if someone is with their spouse or not
