Hi everyone, I'm new here. A friend of mine recommended me this site to help me out on applying a K-1 visa.

My annulment still in process. It's been a year since I filed it but still waiting to be approved.

My boyfriend and I wonder if we could start now in filing a K-1 visa even if my annulment still in process.

Please help me out, I would appreciate you response. Thanks and more power!

No -- your boyfriend cannot file an I-129F petition for you until after your annulment has been finalized.  Both the petitioner and the beneficiary must meet all the eligibility requirements at the time of filing the petition, and one of those requirements is that you must be free to marry.

 

Where did you file your annulment?  Which country?

Thanks for the info.  Hopefully you and your boyfriend are prepared to wait another year or two before he can file a petition for you.  2 years is an optimistic estimate for an annulment from the Philippines.  Wishing you a speedy process.

Do not file until the annulment has been finalized.

You MUST file evidence that all previous marriages were terminated along with the I-129f.  In addition, you are not free to marry until the annulments is complete.  Thus, you cannot start yet.

August 7, 2022: Wife filed N-400 Online under 5 year rule.

November 10, 2022: Received "Interview is scheduled" letter.

December 12, 2022:  Received email from Dallas office informing me (spouse) to be there for combo interview.

December 14, 2022: Combo Interview for I-751 and N-400 Conducted.

January 26, 2023: Wife's Oath Ceremony completed at the Plano Event Center, Plano, Texas!!!😁

February 6, 2023: Wife's Passport Application submitted in Dallas, Texas.

March 21, 2023:   Wife's Passport Delivered!!!!

May 15, 2023 (about):  Naturalization Certificate returned from Passport agency!!

 

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Thank you! I have other question if you don't mind. I understand that we can't file K1 visa just yet as my annulment still in process, yeah I get it but is there any way that my boyfriend can request to get all those paperwork so he can start reading them or how is it like or at least he'd get the process procedure? Thank you, I appreciate your response really!

Take note that the details about the procedure may change in the future.  You and your boyfriend should make sure to check the latest instructions and form version from the official USCIS website before filing.

Yes, you can prepare everything so that the day your annulment is final you can apply.  And honestly, this time should give you the opportunity to get everything together to have a GREAT application once you are able to apply.  Everything is already public about the requirements and process, so you can start asking questions in the forum about filling out the forms.  Just don't submit them until you are legally able to marry.  Also, you are in the right place, there are dozens of people here ready to help you with every question you might have.
