In lieu of the 2020 Transcript? No. That has to be provided regardless.

If you want to prove his CURRENT income meets the poverty guidelines (because his 2020 transcript doesn't) then you should provide an Employment Verification Letter stating his 2021 predicted income and back that up with 6 months current paystubs.

If the poverty guidelines were met with the 2020 Transcript, that's all you need.

Input his gross total income from transcript in Qu 7.

No need to complicate things further with an EVL and paystubs.

The I864 instructions go into detail about what you MAY submit.

No need to go overboard though.

Yes, I am aware that I must also include the tax transcript. My question was only in regards to the pay stubs. To me it doesn't seem logical to submit more than one pay stub, when it shows the YTD earnings, which is already above the poverty guidelines. I will add more than one, just to be on the safe side. Because my husband has had a payrise, 2020s pay is lower than what he is set to make in 2021. So I will back this up with an up-to-date employment letter and yes, paystubs. Thanks for your response!

11 Dec 2020: I-130 approved

17 Dec 2020: NVC Received

25 Jan 2021: Paid AOS and IV fees

14 Apr 2021: Submitted I-864, I-864A and DS-260

14 Apr 2021: Expedite request

04 May 2021: Expedite approved, case sent to Consulate in Naples, Italy

 

US Consulate Naples, Italy

04 May 2021: Consulate received

18 May 2021: Requested expedited interview

20 May 2021: Expedited interview approved and scheduled for 8th June

07 Jun 2021: Medical at Istituto Varelli (Naples, Italy) - Very friendly staff, spoke English

08 Jun 2021: Interview - APPROVED

09 Jun 2021: Picked up passport with Visa in person from Consulate 

 

USA

17 June 2021: Entered New York (JFK) as Point of Entry

17 June 2021: Landed in Arizona and reunited with my wife :) 

28 June 2021: Received Social Security Number

10 July 2021: Form I-551 (Green Card) marked as in production

15 July 2021: Form I-551 (Green Card) received in the post

I agree. Better to be safe than sorry! Luckily I have 6 months printed. Looking through them, they will actually help support the increase in pay. It's always to good to check with others, easy to get overwhelmed during this process. Thank you for your reply

Id read and follow the instructions first:

 

"You may include evidence supporting your claim about your expected income for the current year if you believe that 
submitting this evidence will help you establish ability to maintain sufficient income. You are not required to submit this 
evidence, however, unless specifically instructed to do so by a U.S. Government official. For example, you may include 
a recent letter from your employer, showing your employer’s address and telephone number, and indicating your annual 
salary. You may also provide pay stubs showing your income for the previous SIX months. If your claimed income 
includes alimony, child support, dividend or interest income, or income from any other source, you may also include 
evidence of that income."

 

If providing paystubs not following the number they state may be a problem.

Thanks, I have read the instructions already. I could still argue that one pay stub with the YTD earnings included, does still show the earings from the past 6 months. But I will include these paystubs anyway

 If his income on the tax return is well over the threshold, then you don’t even need the optional pay stubs. Making even more that a lot already (shown on the tax return) does not get you a lot more approved. I would feel perfectly okay with the year to date info. I would photocopy it then circle YTD and write a big note in the blank space on your photocopy “ seven months of income shown in year to date”.  Or however many months (or weeks) fits your paystub.  I believe in connecting the dots so they know what you are showing them.
 

 And I like your logical thinking. I think the reason they say 6 months is because they want half a year of proof if you are claiming more than the tax return shows. And it covers people whose checks vary because they are hourly workers. You have a summary of x-number of weeks or months. Go with your logic. It’s superfluous info anyway.

I didn't include any pay stubs with our AOS package. Just the past 2 year tax transcripts with no issues for the I-864.
