Timeline

I've never actually filed a tax-return. I've had W-2's from my work, but I never bothered to file. Will this impede the visa process?

Filing country is Australia, and my parents (the co-sponsors) make far and above the poverty line. Would me bringing in last year's W-2 help show that I've had a job, or will I even need that with my parent's sponsorship? The interview is coming up VERY soon and though I requested one 3 months ago, the IRS wouldn't send me a tax transcript showing that I've never filed taxes before >.<

01/28/07 - Joined VJ

01/29/07 - Began gathering neccessary information and attachments for I-129F form:

02/07/07 - Recieved signed documents from Rob to be sent with the I-129F

02/16/07 - I-129F packet sent to Nebraska Service Center

02/21/07 - I-129F packet recieved at NSC at 7:56 am

03/01/07 - Recieved packet back from CSC - check dated wrong! (2006, not 2007)

03/01/07 - Sent packet off again - directly to CSC this time

03/05/07 - Case recieved and dated.

03/06/07 - Check cashed and number recieved!

03/09/07 - Touched

05/18/07 - Touched and approved! 78 days in all!

05/21/07 - Confirmation e-mail recieved!

05/28/07 - Hard Copy of approval recieved.

06/01/07 - Recieved at National Visa Center and letter sent.

06/06/07 - Letter notifcation sent (in time for my fiance's birthday!)

06/12/07 - Packet 3 received by fiance.

06/13/07 - Initial form sent off.

06/21/07 - Police interview

06/21/07 - Packet 3 expressed to Sydney

06/22/07 - Medical

07/02/07 - Packet 4 and interview date recieved! Interview is:

07/18/07 - Interview in Sydney! - Approved!

07/19/07 - I get to see Rob again!

08/06/07 - I fly back to the states to plan a wedding and prepare for him to move over.

09/10/07 - Rob enters the US via JFK in NY

09/28/07 - Our Marriage

You need to file your past tax returns ASAP. While you are using a cosponsor for this phase, you will need to have everything in order when your fiance moves here and you adjust status.

What do you mean you never bothered to file? Did you make an income below the level necessary in order to file? Otherwise you need to file an income tax return. You need to provide check stubs to show that you have a job currently, in conjuction w/ the W-2 forms....but if your parents are the co-sponsors, then it is their financial documentation you need to worry about gathering. You will fill out the I-134 and so will your parents and they will need to include all the supporting evidence related to proving sufficient income to support the intending immigrant, your fiance. If you've never filed taxes before, why would the IRS send you a transcript attesting to that. You're not in their database, period. How can they send you documentation attesting to something they don't know about? :blink:

In order to sponsor an immigrant, later for AOS, you the spouse of the immigrant will have to be th primary sponsor for AOS later when in the USA, and in order to file AOS, you will have to attach I-864 to the AOS paperwork, I-864 requires IRS returns to be filed.

Living out of the country exempts citizens from paying some taxes, but does not exempt you from filing returns every year.

Yes, it will obstruct your process. Co-sponsor or no co-sponsor, you have to present your tax returns: file them as soon as you can!

Just to be sure you know this.... and it seems that it is often confused here, when you are filing for your K-1 there is only a need for one sponsor. This means that if you cannot demonstrate the minimum allowable income but your mother or father can then no problem. Just have them fill out the I-134 and have them write in Mother or Father of Fiancee.

Like YuAndDan said you will need to be the primary sponsor for the AOS but not yet.

My fiance had her successful interview last friday and my mother alone sponsored her.

i have a relevant question that i would like to add to this discussion...

last year (2006) i was still in school and made only worked part time...my income was below the minimum level required in order to be required to file taxes (i even tried to, but the guy at HR Block told me that there is no reason to file)....now i am out of school and working full time, and make well above the poverty guidelines...

should i send in my 2006 W-2's from last year in order to show them that i was below the minimum and didnt need to file?

does it matter if i was below the poverty guidelines for the past two years (2005 & 2006), even though i am well above them now? am i still eligible to be a sponsor, or do i have to qualify all three years?

Whether you're trying to bring someone to the US or not, you as a US citizen need to file taxes. Period. For now, a co-sponsor will do.

And not just that, but some consulates require an I 134 from the USC fiance even if they have a cosponsor.

We don't know the country of the OP's fiance/e (unless I'm missing it somehow) to say whether or not their consulate will want that.

Like babybluesusie says, there is a minimum taxable income that you have reach before you have to file. I was away for a year traveling when I met my fiance and therefore had no taxable income. I too looked into filing (what I don't know) and found that you just don't file when you don't reach the minimum.

And btw Mononoke, although my fiance is German we met in S.America and got to know each other in person in Colombia. Beautiful country! We spent a couple of months there in total exploring from Pasto in the south to Santa Marta in the north and points inbetween. A real gem.

I've never filed before because I've been listed as a dependent on my parents' taxes since it's always been worth more for him to have me listed as that than for me to file since I've never worked full time and have not made enough money to be taxed (I've been a student, mostly). I attended school for 4 months last year and worked part time, then full time for 2 months before spending the next 5 over in Australia studying, so my income was very minimal ($3000 or so).

I'm actually going to the firm that does my parents' taxes next week to pick up a third copy of theirs, so I will set an appointment to see if I can file them at that time so I've got things in order for the AoS.

My fiance is from Australia, on the question from his country.

pleasant day everyone!

i have been a member here but never posted because i get answers to questions from other members posts and replies until now. please if anyone out there could clarify and verify some questions or replies from u guys that i didnt understand. some of it are:

1. If God permits and i will get approved on july 10 2007 or after doing the intial steps onprocessing the k1 and be in the US and then have to apply for AOS,

does it need that my fiance/soon to be my husband be my primary sponsor or we still could use his parents which was our co-sponsor during the initial process of k1.

2. if it need tobe that my fiance be my primary sponsor then he would need to have his own ITR on the AOS application.(right or wrong?). what if in the past 3 years he neverhad an income because in 2004 he was a student, 2005-2006 he still was learning on how to do the real estate job from his mom and that all sales they had were on his mothers name and none in his name therefore no income again in 2005-2006. although this year he made one sale on his name and at the same time has another job. problem now he never filed for any ITR within the past three years. so if he needs to be my primary sponsor during AOS application he needs to file for his ITR even if he never hadan income for the past 3 years(right or wrong?)....

i know im too early asking this ones coz still not yet approved but just wanted to be ready just in case and so i could tell my fiance to file his ITR if needs to be so he can do it while we have more time allowance ....
