Hello,

 

My wife and son came over to the US over five years ago and both have green cards. My son is 6 years old. He was born in Japan and I couldn't pass citizenship to him (I'm American through my parents but can't prove I was in America for over five years total). I'd like to get my son Citizenship.

 

I am wondering what would be quicker:

- Getting the citizenship through Grandparents (N-600K)

- Getting citizenship normally after 5 years with a green card

 

Does anyone have any recommendations?

Your son already is a US citizen per INA 320:

Since he already is a US citizen you can apply for his US passport. The process for US passport: https://travel.state.gov/content/travel/en/Intercountry-Adoption/adopt_ref/adoption-FAQs/child-citizenship-act-of-2000.html

you will need to present the following when applying for your child's U.S. passport:

  • Proof of the child’s relationship to the U.S. citizen parent. For the biological child of a U.S. citizen, this generally will be a certified copy of the foreign birth certificate (and a translation if the birth certificate is not in English). For an adopted child, you must submit a certified copy of the final adoption decree (and a translation if the decree is not in English);
  • Proof the child is admitted as a lawful permanent resident, such as the child’s foreign passport with a I-551 stamp, or the child's permanent resident card (green card);
  • Proof of identity and citizenship of the U.S. citizen parent(s);
  • Evidence the child is residing in the United States in the legal and physical custody of the U.S. citizen parent;
  • Completed Form DS-11 and supporting documents.

As said above you can apply for a US passport directly for your son, and that's all he needs to prove his citizenship.

 

Additionally, filing form N-600 is not really necessary. But if you can afford it and want additional document proving his citizenship, then you can also apply for certificate of citizenship, N-600. Since, your son is less than 14 years old he will not be required to appear for an oath of allegiance ceremony.

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

After you get your son a passport and passport card (get both because the this gives your son two proofs of citizenship and makes it easier to replace one when the other is lost), you should file the N-600 if you think there is any chance your son will

 

* enter federal service in a job requiring a security clearance.  A certificate of citizenship will be required. 
 

* petition a family member such as a spouse for immigration.  Some IOs will require the certificate of citizenship 

 

* register to vote online in Tennessee: the certificate number is required
