Hello

I'd really appreciated your help in this subject, I sent my I-485 package to Chicago PO Box on May 6 2021 and they received it on May 15, but first I filled online the I-130 on May 1, I didn't send all together because I didn't have all the documents for my I-485 just until May 6. 

They sent me the NOA 1 to the I-130 but I don't have any answer about my I-485, I called today to USCIS because they haven't cash the money and I'm a little concerned about this, maybe could be a problem that I didn't send all the documents together???

USCIS told me that they can't give me any information about it and I have to wait 60 days. 

Please somebody answer about your experience or maybe something similar.

@Karen Mejia, I do not think there is an issue. Your filing is still considered concurrent even though you filed the I-130 online first and then, you mailed the I-485. I would just be a little patient.

I should mention that lately, rather recently, USCIS has been adjudicating/approving I-130s filed online. I would not be surprised if you get an approval within a month or two.

06-15-2021 - Case was updated to show fingerprints were taken. 

05-26-2021 - Received NOA/extension letter. Notice date and postmarked 05-20-2021.

05-23-2021 - Received text message with Receipt #. YSC Potomac Center.

05-21-2021 - Checks cashed (processing on joint checking account)

05-07-2021 - I-751 received in Arizona.

 

Marriage-based AOS - Concurrent filing.

05-07-2019 - AOS Approved. Resident since date 05/07/2019.

05-06-2019 - AOS Interview

04-23-2018 - "Case is ready to be scheduled for an interview"

03-16-2018 - Priority Date.

Did you send i130 receipt along with the i485 package?

@Karen Mejia, please let us know when USCIS approves the I-130. They've been approving online filings quickly lately.

Good morning 

 

Yesterday I received my original I-485 package back from Chicago PO Box, they also sent a letter, a NOA of Rejection Notice, the reason they said in the letter is the following:

 

Based on the information you provided, your priority date could not be established.

Also they are asking me for the original I-130 Form (I filled that online)

A copy of my form I-797 if the I-130 has already been filed/ approved

Other evidence that an immigration visa petition has been filed/approved on my behalf.

 

Please help me, I don't understand what's wrong with the package, I noticed they checked all the forms and evidence I sent because they put some kind of codes in the bottom of each page,  but in each form (I-131 / I-765) they sent a Rejection Letter.

There is another thing, in the Rejection Notice 797C of the form I-765 they put Eligibility Category: C9. I'm sending attached the letters with the information.

 

I'll be waiting for your any answer with your help, thank you so much in advance.

That's the mistake you did. You didn't send a copy of the receipt notice that you could download from your online i130 portal.

 

You can resend the entire package with the i130 receipt notice and it'll be all good.

Hello everyone

 

USCIS sent me back the package again, this time with a Rejection Notice because the fee was not correct.

I sent one check for USD 1.225 with the Adjustment of Status forms (I765- I131- I864- I130- I130A).

The money for the I130 was cashed on May 1 and I sent the Notice of Action with the Receipt number for this Form.

Could anyone of you tell me if you have been in this situation and What should I do?

I called to USCIS but the woman who answered the phone said she can't help me and somebody is gonna call me in 7 days.

It's probably a typo, but just to be clear -- you included form I-485 in your package, right?

Did you include forms I-130 and I-130A again even if you already filed online?

What eligibility category did you put in your form I-765?

 

Also, your profile indicates K1.  Did you enter with a K1 visa?  If so, why did you file with an I-130?

Yes, I included form I485, I130 and I130A again. 

I765 Category C9

I started as K1 but then I came here with my tourist visa and got married so my husband started a new process.

 

What's a typo?

That's the mistake.  You shouldn't have included forms I-130 and I-130A again since you already filed online.  If they see those forms in the package, they will expect the $535 filing fee for I-130.  So your $1225 check was not enough.

 

For your next submission, include only the I-797 receipt notice for the I-130 already filed, not the actual I-130/I-130A forms.
