i864 income questions (Part 6)

Hi. Hopefully this is the last time I need to make a thread about this.

 

I have a few questions about the i864 form and reading the instructions is not helping. For the background, we filed a joint tax return for 2020 so we do not know how this affects the answers.

 

I864 - PART 6 - Line 20 - My current HOUSEHOLD income is... 

 

So, for the tax return we included both of our income for the 2020 tax year. Does this mean we need to combine income again for the current houshold income or do we continue to put the income of the people living in the household and NOT INCLUDE the spouse's (applicants) income?

 

I864 - PART 6 - Line 24a - My total income (adjusted gross income on Internal Revenue Service (IRS) Form 1040EZ) as reported on my Federal income tax returns for the most recent three years was:

 

Pretty much the same question as above, do we include the total gross income of both the USC and the NRA (Spouse/Applicant) for this section? 

 

And finally, a question about a section a little earlier. For the sponsors household size, I have attached an image to show what we think is the right answers. The USC CURRENTLY lives alone and they are the sponsor to the spouse and nobody else. No kids or other household members. Does the screenshot look correct for our circumstances? I know it says add 1-7 together but it has autofilled in the PDF when entering. Does it stay as 1 or do we have to change it to 2? This question is about YOUR income.  "My" is a personal pronoun.

Enter the number from the total income line of the tax return.  It's "My" again, but it's about a specific line on the tax return.  You've asked about two numbers.  They need not match.

The current household is two, you and the person you are sponsoring.  This is definitely covered in the instructions, and if the form is functioning properly, it will add 1 and 1 and autofill the household size as 2.  Are you using Acrobat, or Adobe reader, or some other program?

In regards to the income thing thing again, it says MY HOUSEHOLD not MY PERSONAL. If my spouse is treated as a resident alien for tax purposes, does this mean it applies to this section for questions about HOUSEHOLD income

There are two income question.  One is YOUR income.  Use a pay stub to calculate it.  Take the gross for a full pay period and multiply it by the number of pay periods in a full year, ie: every two weeks is X 26.  In the tax section, enter the number you see on the "total income" line of your 2020 federal tax return.  It really is that simple.

 

Each question has a context.  Stick with the proper context.

 

Your household size should be two.  If you can't get the form to do that for you or edit it to be correct, then use Adobe Reader instead.  It's free, and the forms are designed and built with Adobe Reader in mind.

Just seeing your post.
 

READ the entire question. It says nothing about tax returns.
Part 6 #20 says to total all lines from part 6, Lines 7, 10, 13, 16, and 19. 
 

So look at Part 6 and ADD

Line 7 ( your current individual income) $xx,xxx.xx

PLUS +

Line 10 Person 1 (blank)

PLUS +

Line 13 Person 2 (blank)

PLUS +

Line 16 Person 3 (blank)

PLUS +

Line19 Person 4 (blank)

 

The only entry you should have is line 7, so ADD your individual income plus 4 zeros.
Line 20 is the same number as Line 7, your individual income. You can’t list your wife as Person 1 because her income will not continue from the same source in the US. 
 

When you get to 24 a,b,c, there is nothing to calculate. You just copy the numbers straight off your tax returns. Find the line that says total income on each return. No over thinking..just copy the number.

Is your spouse working in the US? Why would he/she be treated as a resident alien for tax?

Because she is married to a US citizen and they made the election to do so. See IRS Publication 519.
