Waiver (212)(d)(3) for tourist visa

Hi everyone I don’t know if iam in the right section to ask my question related to tourism visa . 
i overstayed my esta and I have a 3 year bar . I know That there is a waiver called 212 (d)(3) to be admissible to the us through a b2 visa. Everything through the the ambassy as it is g the discretion to the co to recommend you for a waiver . 
does anyone here have already gone through this path and had an approved waiver ? if yes can you tell me how you convive the co to recommend you for the waiver and what evidences you put when you file . 
your help is so much needed

I think you can pay and try but the burden is on you to prove that you won't overstay again which will be pretty hard most likely. You will need to provide convincing ties to your country. If you got a 3 years ban it means you overstayed at least 180 days which is probably proves that it was intentional.... Another question for B1 will be even if you get the wavier if you worked illegally while in the US....

 

When did you receive the 3 year ban? Did 3 years passed since then?

These are the questions that you will have to address.

 

Why did you overstay in the US for at least 180 days?  Did you work illegally?
 

With a 3 years ban for overstaying at least 180 days and having recently left, why do you want to come back?

Just read your other threads about marrying your US boyfriend by proxy.

 

With immigrant intent, you have zero chances at a waiver for a non-immigrant visitor visa.  You want to bring your child and live with your US boyfriend. 

 

In the other threads, you have been advised to get marry outside the US, file for the CR-1 visa, and file an I-601 waiver.  That is your only real option.
