Hello,

I'm a little concerned to be outside our house with my I-94 date expired. What could I reply if I'm stopped and don't have any document from the USCIS that proves that I'm in the middle of a process of AOS

We send our papers mid february (before my I94 expiring, and probably won't have any documentation that states that we are in the middle of the AOS process.

 

I'm not freaking out becuase I read nothing will happen, but just wondering the worst case scenario.

Our Journey:

Feb 18th, 2021: Package sent, including: I-130 + I-130A, I-485 + I944 + I-693 + I-864, I-765) and I-131 through USPS

Feb 24th, 2021: USCIS received the package

Apr 5th, 2021: Package rejected, received back (Payment issue)

Apr 6th, 2021: Resent Package through USPS

Apr 7th, 2021: USCIS received the package @ Chicago Lockbox

May 21st, 2021: Checks cashed

May 23rd, 2021: Received the Text Messages with receipt number 

July 2nd, 2021: I-693 Deficiency Notice Received

July 8th, 2021: Expedite Request Received

July 16th, 2021: Received Fingerprint Appointment Letter

August 6th, 2021: Fingerprints Taken

August 9th, 2021: Changed of Address request AR-11online (Beneficiary) and filed I-865 Address Change of my husband (Sponsor)

August 13th, 2021: Confirmation mail: Case is Ready to Be Scheduled for An Interview

November 17th, 2021: EAD Delivered

March 15th, 2022: Interview Scheduled

April 21th, 2022: Interview / New Card Being Produced

April 22th, 2022: Case Was Approved

Marriage, in itself,  conveys no immigration benefit or legal status in the US.  Once a person submits a proper I-485, then that person is granted "authorized stay" in the US until the I-485 is adjudicated.  However, authorized stay is not a legal immigration status.  

The OP is concerned because the I-797, receipt for the I-485, is the evidence that he/she has been granted authorized stay.  

 

Any non-immigrant is technically subject to removal after the expiration of the I-94 (married or not).  In this case, the OP is legally authorized to remain in the US until the I-485 is either approved or denied if a proper I-485 was submitted.  The issue here is proving that a proper I-485 has been submitted.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

mhmm basically that I always read that I should be carrying always documentation and ID, and when in the US I should have my i94 with me because the last two times I came here my passport wasn't stamped

Do you live near the border? If not then don’t worry about it.
I’ve never heard of someone carrying their I-94 I assume the vast majority of people who come to the US for immigration or tourism don’t even know what that is.

You should receive the receipt(s) soon.  Give it another week or 2 and then call.

yes! Next week will be one month after they received our packet!
