bringing mother of US citizen with a 20 year old son

Hello everyone!

 

Could you please advise how it is better to bring to the US my mom and her 20-year old son (my half brother). Do I need to file for my mom and then my brother will be automatically included into the process? He will turn 21 in October 2021. Do we have enough time? How to speed up the process?

 

Or do I file for f4 sibling visa for him (but then it is like 15 years).

Or is it better to file for my mom and then once she gets her green card, she would file for him (but it is again like 15 years).

When you file for your mom, it will be a petition for immediate relative of US citizen.  IR visa categories do not allow derivative beneficiaries, so your brother will need a separate petition.

 

Getting an immigrant visa for your brother would be faster if your mom files a petition for him after she becomes an LPR (assuming your brother remains single) than if you filed a sibling petition.  Note that it is unlikely that your mom will become an LPR by Oct 2021 since you haven't even filed for her yet.

 

There is no way to speed up the process, unless you have a life-or-death or other extreme situation that requires your mom to be with you in the US.

You can file for your mother. But her son (your brother) will not be included. Even if he was younger he would not be included. That being said, he is old enough to be an adult and have his life. The need to have him here is less important than say a spouse or minor children in the eyes of immigration.

There is no way to speed it up. He would not be included regardless of when you file.

Both you and your mother can file for him. Yes it is going to take years but that is the reality of immigration. Sometimes you can't have everything at once. Be thankful that you can bring him at all because this option may not be available in the future.
