Spouse visa / getting married in US on travel visa

but in this case we have to start the process all over again, no? and we will lose some time in order to move to US. I know that if we do fiancé visa after moving to US we would have to petition the change of status and also me waiting for work permit, etc, but at least we would be able to stat our lives there, and for me to get used to the new country. We are in our 30s and time does matter for us career wise, starting a family, ets. I think you understand what I mean.

its pretty bad satiation I see. thanks for letting me know. just wanted to save some time, so we wont have to travel to Russia again for this. I guess its not happening than.

It's not usually an issue. I assume you have a lot of proof

Hi guys,

 

sorry, I have another question. My passport will expire in April 2022. For now when we will start applying for K1 (I think this is what we decided upon), we will fill my current passport number. I will apply in Russian consulate soon to get an additional passport (we can have an additional passport to the main one, and both are valid), which I'm planning to replace with the current one when it expires.

 

Won't it create a mess? and is there a way to file that I just replaced old passport with a new one because previous has expired? Is it a big problem?

It's not an issue. The new passport info can be provided in the later forms (i.e. DS-160).

Hi guys, I would like to ask for your advice.

 

Just now I read the topic about possibility of getting married online through the statue of Utah. I remember last time some of you actually proposed this option, but then it got denied. 

 

But it seems to be totally legitimate and apparently possible for both of us regular ppl (not military), there is no need for physical presence for application, and the marriage certificate doesn't state anything about online marriage. Several users of this website got approved CR1 having this type of marriage.

 

What do you think? Any cons of getting married this way for us? Can it bring any troubles in the future?

That part is incorrect. The thread you are referring to did "consummate" the marriage before filing I-130: "Online marriage ceremony in September 2020. I visited him in Costa Rica in October 2020 and filed for the CR-1."

see INA 101(a)(35): "The term "spouse", "wife", or "husband" do not include a spouse, wife, or husband by reason of any marriage ceremony where the contracting parties thereto are not physically present in the presence of each other, unless the marriage shall have been consummated."

But we live together and see each other every day. So if we do online marriage via Utah office, we would be doing it in front of each other. Am I understanding it all wrong?

My apologies, I didn't reread your very first post. In your case, you can marry online and then file I-130 online. You being physically together is enough.

yes sure. we got married online via Utah in June and applied for spousal visa. PD Aug 10. Active review Dec 14.
