Please forgive me in advance if I didn't post this in the proper thread.

 

As we all know, with Trumps proclamation IR5 is on hold until the end of the year...

I am worried Trump might renew his proclamation before Biden is sworn in, and if Trump does do this I just don't see Biden doing an executive order right away to reverse the decision.

 

Let's hope Trump doesn't renew his proclamation. My In laws have had their case approved at NVC for a while. Their interview will be in Rio De Janeiro. With the below information when do you think they could possibly receive an interview? I completely understand no one knows for sure and we are all assuming. But  my in laws will need to start selling off their personal property to prepare for the time. I would love to hear your educated guesses even if they are just a guess....

Trump certainly can extend the ban.  Biden has said he will reverse the bans if he is sworn in as POTUS.  However, Biden could institute travel bans due to Covid.  We shall see.  I would STRONGLY advise your in-laws to delay selling off property, etc.  until they have visas in hand.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Hey lucky!, thanks for your fruition. They won't sell off anything until they know for sure ofc. I missed when Biden said he would reverse the ban... but adding a travel ban would be just as bad. Appreciate the reply!

 

I heard tourist are allowed back into the USA I haven't researched this myself at all, but if that is in fact true it would be horrible for us waiting to bring family members to the USA.

They live with their son and have little property as is. Selling anything won't be life or death for them. Anyhow any guesses on interview dates? 

 

I am unsure if that priority date has much to do with it?

The PD doesnt really cause this is not a numerically limited category. The backlog due to covid and the travel bans will be substantial so its almost impossible to give a realistic expectation could be a couple months could be a year.

Hey, I am a fellow Brazilian - also waiting for interview. My DQ was back in May.

 

A few things you can do to get somewhat of a timeframe;

 

1) Fill out your timeline. This way VJ will understand what type of visa you are applying for, which country, your PD, etc...

2) Go to Portals (on top of the VJ website - you´ll see a tab with that name). This tab will link you with other fellow Brazilian in similar situations. You can see when the last interview date was (3/10) and you will see who the next people in line are... Some are January (who knows if it will get cancelled?) some are June...

 

Personally, I don´t believe any regular interviews will happen before Feb/March... they will begin by earliest DQ dates (they have not interviewed in 8 months) and expedites. My guess is that we´re looking at at least another 8-12 months.

Trump extending the EO is almost inevitable. He will use his Executive powers until his last day in office that we should all be sure of. Biden too once sworn in will remove all those E orders as he had said before including travel bans for banned countries. As this vaccine has been approved, be sure travel bans will also be relaxed tremendously so as to allow the economy to start functioning again. So what we should look at really is come January 20 when Biden is sworn in and plethora of EO in the subsequent days or weeks after. But it certainly won’t be long after he takes office.
