Timeline

My husband and I live in Canada and I am the US citizen. Our case has been going on for about 10 years but Finally we used an attorney and filed an i601 hardship waiver that got approved in 3 months. We just got notified last week. My concern now is will they require me to be employed in the US before they issue the visa? We had a consular interview a few years ago and they mentioned we need an approved waiver and I need job in us to show my intentions to return. 

 

Getting a job there while I'm sitting in Canada is not so easy especially during covid.

They want to see US domicile. There are multiple ways to show this

How? I really don't want to leave my husband and live separate again...I did this my first few years of marriage. 

 

My plan is if he gets visa we will initially live with my mom as her house is empty. I have a bank account there already but I have my mom and brother as cosigner for security reasons

Yes but I don't really pay as I am in Canada I show foreign income and you only pay in one country but my attorney submitted all my tax return forms with waiver documents...any other ideas

Heres a list:

  • Federal income tax returns
  • Home ownership or active lease with evidence of maintaining home
  • U.S. bank account or other investments
  • Pay stubs from U.S. employer
  • Registering to vote (if a U.S. citizen only)
  • Children’s registration in school
  • Your voting record in the United States;
  • Records of paying U.S. state or local taxes;
  • Having property in the United States;
  • Maintaining bank or investment accounts in the United States;
  • Having a permanent mailing address in the United States; or
  • Other proof such as evidence that you are a student studying abroad or that a foreign government has authorized a temporary stay.

Maybe I should enroll in some courses down there...I didn't vote in this past election, I do have a 401k there and the bank account and 1 credit card, we don't have any children and my moms house is paid off so I don't think I can add my name to that...I'm thinking of job searching down there...considering everything is remote with covid id hope I can get something and sit in Canada and do it even if I'm paid in US

Please visit the domicile thread in the Canada regional forum.  The US consulate in Montreal is far more strict on domicile than any other place on the globe.  

That you don't want to be separated isn't their concern.  That you have a home in the USA, with the evidence to back up that home (bills, job, daycare, etc) is of vital importance to them.
