Good evening:

 

My mother-in-law will be filing her I 485 shortly on a family based application.  She will be adjusting status in the US.  I had a question on the EAD.  If she babysits our child, and is paid for it, do we need to file an I765?  Annualized, it would be less than the IRS requirement to file a tax return.

Yes. Looking after a child that is not yours is work. She cannot work without her EAD. She would be taking a job away from a USC or LPR.

A grandmother charging to spend time with her grandchild?  There is a difference between babysitting work and you giving your mother-in-law an allowance while she's with you.

 

Also...how is she adjusting status?  Is your wife a US citizen?  Your profile states K1 visa.
