Timeline

For those who are flying. Make adjustments to your next flight back after doing immigration.  Secondary can take time. Hated that every time I came back as a LPR. Now I enjoy having global entry.

Timeline

I chatted with a tier 1 on Thursday. He told me I am not allowed to work on an expired greencard until I get my letter.

I requested to be connected with a tier 2, since that was different from the information I have. He set me up to be called back withing 7 days. 

My greencard expires 1.28, so I arranged to be off work. Better safe than sorry.

I understand, thats why I asked for tier 2.

 

I appreciate all the help and expertise I find on visa journey. It has helped me navigate this journey many many times over the past years.

 

But I cannot in good conscience go against a direct answer from a government employee like that. Be it an Indian callcenter or not. 

Like I said, better safe that sorry.

Fortunately I am in the position where I can afford to stay home and wait it out. 

 

I will keep you posted once I hear from tier 2

And as for most simple google searches, they are often superficial or simply inaccurate. This article was written for an expired unconditional 10 year greencard.

As you know, I have a conditional greencard, and am applying for removal of conditions.

If anything this following article is more accurate. But this one will not go into detail on working on an expired conditional greencard either.

I'm confused. 

My gc has expired and im still working. It was not my fault that the mail took extra long and it is not my fault that covid is here causing delays. I did everything I was supposed to. 

I should receive something within the next two weeks I think.

You can keep working. Your status as a US resident has not ended either. Your condition is still the same, being married to a USC and filing for removal. You "conditional" GC is called so because of a  wording matter and it is not so much different from a 10 year GC. The only difference of both cards is that, the 2 year is to proof that the marriage was not a sham to try to get residency here.

Thank you! Reading the other post freaked me out. I thought I was in status still as I've seen several comments saying that it means status is still valid. It is just the card that's not.

I'm currently almost at a month since it was delivered. I've emailed the lockbox to ask. Im sure they haven't touched December 26 arrivals of packages just yet.

all you can do is have patience and wait. Everyone chooses their own path as you read above. As for another matter from post few days or weeks back...do not drive with an expired DL. That has real hard consequences. Good luck (here from a 5sec commentator on a random website called VJ) lol.

Yes, my DL expired yesterday. 😢  Same day as my GC expiry date.

I think the important part to note here from the customer service person is "due to not having proof of valid status" ..if you already have a job you don't need to proof anything (in my opinion) and I think they aren't allowed to reverify your employment status. That's how I would see it. For me personally - I wouldn't be able to work anywhere outside my home because my DL expired at the date of my gc expiration date and I can't drive anywhere. Usually it shouldn't be an issue with getting the extension letter in time but with covid it just happens. 

 

Maybe for new people reading this -> file as early as possible so you don't have to worry about running out of time. 🤷🏼‍♀️

Wow! This is the first time anyone has ever posted that one can't work on an expired gc. You are absolutely free to believe and proceed how you feel comfortable, but there are hundreds (maybe even more) that are currently working on an expired gc because USCIS is really backed up. "We" have up through the day of the expiration date is said gc to have the ROC delivered, maybe even just postmarked. 

My husbands gc expired Dec 21st and we still don't have the extension letter. His work would never let him stay employed with paid or unpaid time off for something completely out of our control. 

Let us know what the tier 2 says, or even better, call again Monday and ask another tier two and see what answer you get.

I have my husband driving me and picking me up from work right now because my GC and my DL expired yesterday 22nd Jan. I filed in good time it is just super backlogged and uscis even put out a statement on their website to say they're 4 -6 weeks behind. This pandemic is causing so much mayhem and chaos. 😬
