Hi all,

 

We are filing our I-130 and I-485 on Wednesday. It would be appreciated if you would take a look at the documents we're submitting and advise if we're missing anything.

Form I-130

1)      A check for the amount of $535.00 to cover the filing fee;

2)      Form G-1145: e-Notification of Application/Petition Acceptance;

3)      Form I-130: Petition for Alien Relative;

4)      Form I-130A: Supplemental Information for Spouse Beneficiary, for the beneficiary;

5)      Two (2) photos of the petitioner and two (2) photos of the beneficiary;

6)      Copy of Petitioner’s U.S. birth certificate;

7)      Copy of Petitioner’s U.S. passport;

8 )     Copy of marriage certificate of petitioner and beneficiary;

9)      Copy of Beneficiary’s birth certificate;

10)  Copy of Beneficiary’s passport biographical page;

11)  Copy of Beneficiary’s I-94 and passport entry stamp in valid TN Status;

12)  Evidence of bona fide marriage consisting of:

        a)      2019-2020 lease agreement signed by the petitioner and beneficiary

        b)      2020-2021 lease agreement signed by the petitioner and beneficiary

        c)      Joint bank account statement of the petitioner and beneficiary

        d)      Photographs of our relationship

 

Form I-485

1)      Check for $1,225 (Form I-485 @ $1,140 and biometrics @ $85)

2)      Form G-1145: e-Notification of Application/Petition Acceptance

3)      Beneficiary’s Form I-485: Application for Adjustment of Status and the following supporting documents:

  a)      Copy of beneficiary’s birth certificate;

  b)      Copy of beneficiary’s passport biographical page;

  c)      Copy of beneficiary’s passport entry stamp in valid TN Status;

  d)      Copy of beneficiary’s recent I-94;

  e)      Copy of marriage certificate; and

  f)       Two (2) passport photos of the beneficiary within the past 30 days.

4)      Petitioner’s Form I-864: Affidavit of Support filed by Petitioner and the following supporting documents:

  a)      Copy of petitioner's most recent Federal Tax Return Transcripts for the three (3) most recent years;

  b)      Proof of employment (letter of employment and supporting pay stubs);

  c)      Copy of petitioner’s birth certificate; and

  d)      Copy of petitioner’s passport biographical page as proof of US citizenship.

5)      Beneficiary’s Form I-765: Application for Employment Authorization with the following supporting documents:

  a)      Two (2) passport photos of the beneficiary within the past 30 days; 

  b)      Copy of beneficiary’s passport biographical page;

  c)      Copy of beneficiary’s passport entry stamp in valid TN Status;

  d)      Copy of beneficiary’s recent I-94;

  e)      Copy of marriage certificate;

6)      Beneficiary’s Form I-131: Application for Travel Document with the following supporting documents:

  a)      Two (2) passport photos of the beneficiary within the past 30 days;

  b)      Copy of beneficiary’s passport biographical page;

  c)      Copy of beneficiary’s passport entry stamp in valid TN Status;

  d)      Copy of beneficiary’s recent I-94;

  e)      Copy of marriage certificate; and

  f)       Copy of beneficiary’s birth certificate.

7)      Beneficiary’s Form I-693: Report of Medical Examination and Vaccination Record

8 )     Form I-944: Declaration of Self-Sufficiency is not required to be filed at this time per USCIS guidelines. Find attached the Injunction of the Inadmissibility on Public Charge Grounds Final Rule printed from the USCIS website.

Looks good. I also included G1145 with the I-765 and the I-131. Also, make sure you wrote your name and A# (if any) at the back of the photos. Good luck.

RoC Timeline:

  1. 12/04/2023 - Application sent to USCIS Elgin, IL lockbox
  2. 12/07/2023 - Application received by USCIS
  3. 12/12/2023 - Received "Your case received" text message from USCIS. Receiipt # starts with IOE
  4. 12/13/2023 - Check cashed by USCIS
  5. 12/19/2023 - Received in mail the I797 with the receipt number and the online access code
  6. 12/19/2023 - Received in mail the bio-metric re-use notification
  7. 12/21/2023 - Received in mail the I797 NoA extending my green card by 48 months

FWIW, I've read in several places that duplicate copies of evidence and photos are not required when filing concurrently, and including them is discouraged.  Just to be sure, I called USCIS and asked, and the representative confirmed that duplicates are not required when filing concurrently, and including them creates extra work confirming that they are indeed duplicates and not different in some way.

If you are talking about photo evidences of relationship, you can just send one file for your "evidence" folder. Otherwise, passport photos are needed for I-130, I-485, I-765 and I-131. The forms will be sent to different departments so you cannot reuse those photos and / or certificates.

Unfortunately, I-944 is required again.  USCIS updated that page with the announcement just today -- https://www.uscis.gov/green-card/green-card-processes-and-procedures/public-charge/injunction-of-the-inadmissibility-on-public-charge-grounds-final-rule

 

"If you filed your Form I-485, Application to Register Permanent Residence or Adjust Status, after Feb. 24, 2020, you may be required to file Form I-944, Declaration of Self-Sufficiency. If we receive a Form I-485 before Oct. 13, 2020, that does not have all required forms and evidence, we will request any missing forms and evidence. After Oct. 13, 2020, we will reject your Form I-485 if you do not include the required forms and evidence with Form I-485 at the time of filing."

Did you already do the I-693 medical? If not, you can do it later: https://www.uscis.gov/policy-manual/volume-8-part-b-chapter-4 "Applicants may submit the Form I-693 medical examination report to USCIS: Concurrently with the immigration benefit application; or At any time after filing the immigration benefit application but before USCIS finalizes adjudication of that application. If not submitted simultaneously with the immigration benefit application, applicants may bring the medical examination report to an interview or wait until USCIS issues an RFE requesting the medical examination report." It's common to not submit it at filing, so USCIS just reminds you about the info above:
